Kent fs Thomas Collins of Kent County Gent stands Attached to answer to Benjamin Dollen M.rchant of a plea of Trespasse upon the case And whereupon the said Benj by William Hemsley his Att.rny complains that whereas the said Thomas the 20.th day of March Anno Domini 1694 in sd County within the Jurisdicon of this Court stood Justly indebted tot he said Benj the full and Just sume of Two hundred and Fifty poundes of Tobaccoe by bllance of Accompts therof the said Thomas upon himselfe assumed and to the sd Benj faithfully promised that he the sd Thomas the sd sume of Two hundred and fifty poundes of Tobaccoe unto the sd Benj would well and truely pay when therunto required Yett Neverthelesse the sd Thomas the sd sume of 250.ll Tobaccoe according to his promise and Assumption aforesd to the sd Benj he hath not paid alltho he the sd Thomas by him the sd Benj on the 10.th day of June Anno Dom 1696 att Chester River in sd County within the Jurisdicon of this Court to doe the same hath therunto bee often required but the same to pay ^he^ hath denied and refused to the dammage of the sd Benj five hundred poundes of Tobacco and therupon he brings this suit Hemsley pledges &c.a Jn.o Doe Ric Roe |
