The Court haveing heard the Reason before writed and the
Answers therto and likewise the Arguments Used by both parties
doe give Judgment for Execucon according to the Ten.r of the
before writed scire facias

Therfore it is considered by this Court that the plan.t Simon
Wilmer have Execucon ag.t the Defend.t William North for
the sume of Four hundred Forty and Four poundes of
Tobaccoe and cost of suit

John Wade otherwise called John Wade of Kent County standeth
attached to Answer unto Gerradus Nessels of Cæcil County of a plea
of Trespasse upon the case &c.a

Wherupon the said Gerrardus Nessels by Griffith Jones his Att.rny Complaineth
& saith that the aforesd Wade stands Justly indebted for several
Medicins and other meanes by him delivered as by his acc.o here in Court
produced may more att large Appeare the full and just sume of Five
hundred seaventy and two pds of Tobaccoe being the Ballance of twelve
hundred and Twenty poundes of Tobaccoe as by his accompt ceniments
the 28.th day of ap.ll Anno 1695 which said sume of Five hundred
seaventy Two pds of Tobaccoe the said Wade hath not paid but the same
to pay doth wholly refuse and denie to the damage of the said Nessels Eleaven hundred
pds of Tobaccoe & therupon he bringeth his suit                    Jn.o Doe
