307 This Indenture made this Twenty fifth day of september in y.e yeare of o.r Lord one thousand six hundred Eighty & seaven Between Richard Jones & Elizabeth his wife of y.e County of Kent in y.e province of Maryland of y.e one part & Thomas Smyth of y.e same County & province of y.e other part Witnesseth that y.e sd Richard Jones for & in Consideration of y.e sume of six Thousand pounds of tobbacco to him in hand paid by y.e sd Thomas Smyth at & before y.e Ensealling & Delivery of these p.rsents the Recept whereof y.e sd Richard Jones doth hereby acknowledge and Confess and thereof & Every part & parcell thereof doth hereby Clearely & Absolutely acquit Exonerate & Discharge y.e sd Thomas Smyth his heires Executs & Adm.rs & Every of them for Ever by these p.rsence & for divers other good Causes and Considerations him y.e sd Richard Jones thereunto Especially moveing hee y.e sd Richard Jones by & w.th y.e Consent & approbation of y.e sd Eliz Jones his wife Testefied by her being made party be these p.rsents & signing & sealling of y.e same hath geiven granted Bargained sold Enffeoffed and Confirmed & by these p.rsones doth fully freely & absolutely give grant Bargain sell alien Enffeoffe & Confirm unto y.e sd Thomas Smyth his heires & Assignes for Ever all that parcell or tract of Land Called Trumpington lying on y.e East side Chesepieck Bay in Kent County being part of A devident of Land formerly Belonging to M.r Thomas South and Conveyed from him to Anthony Purse and John Glynson & since then purchased by M.r Nathaniell Euetts being two hundred Acres as by a bill of saile from y.e sd South doth appeare a third part of which two hundred Acres of Land wee y.e sd Richard Jones & Eliz Jones Doe warrant to y.e sd Thomas Smyth & his heires for Ever together w.th all Rights profits & Benefits there unto belonging & Allsoe all pattins Charters & Evidences touching or any wise Conserning y.e same to have & to hold y.e sd p.rcell of Land & Bargained p.rmises to y.e sd Thomas Smyth his heires & Assignes for Ever & y.e sd Richard Jones & Elizabeth his wife for themselves there heires Execut.rs and Administ.rs doth promise & grant w.th and w.th y.e sd Thomas Smyth his heires & Asignes that they y.e sd Richard Jones & Elizabeth his wife there heires Execu.rs and Adm.rs y.e sd tract of Land to him y.e sd Thomas Smyth his heires assigns against all & Every manner of pson whatsoever shall & will for Ever hereafter warrant & defend by these p.rsence y.e Rents & services hereafter to become due for y.e same to y.e Lord Propriato.ry allways Excepted and foreprised and further that y.e sd Richard Jones & Elizabeth his wife there heires & Assignes make due Exknowledg Execute & suffer or Cause to bee made done acknowledged Executed and suffered all & Every such further & other Act or Acts thing or things device or devices Assureance or Assureances whatsoever Requisite in y.e p.rmises for y.e Better & firmer Conveying & more sure makeing of y.e sd bargained p.rmises unto him y.e sd Thomas Smyth his heires & assignes for Ever bee it by Inrolement of these p.rmises fine Feoffment or otherwise or by any such Lawfull way or meanes as by him y.e sd Thomas Smyth his heires or Assignes or thru Councell Learned in y.e Law shall Reasonably Advised or Required In Wittness whereof y.e sd Richard Jones & Eliz his wife have hereunto set there hands & fixt their seales y.e day & yeare above written Richard Jones signed sealed and delivered p in the p.rsance of Elizabeth Jones John Coperly William Pickatt |
