305 This Indenture made this twenty second of August in y.e year of our Lord one thousand six hundred Eightty and seaven Between Phillip Conner and Mary his wife of y.e County of Kent in y.e province of mary Land of y.e one parte and Thomas Smyth of y.e same County and province of y.e other part witnesseth that y.e Phillip Conner for and in Consideration of y.e sume of six thousand pounds of tobbacco to have in hand pd by y.e sd Thomas Smyth all and before y.e Ensealling and Delivery of these p.rsents y.e Receipt whereof y.e sayd Phillip Conner doth hereby acknowledge & Confess & thereof and every part & parcell thereof Doth hereby Clearly & absolutely acquit Exonerate & discharge y.e sd Thomas Smith his heires Executors & Adm.rs & Every of them for Ever by these p.rsents and for divers other good Considerations have y.e sd Phillip Conner thereunto especially moveing hee y.e sd Phillip Conner by & w.th y.e Consent and approbation of y.e sd mary Conner his wife testefide by her being made party to these p.rsents and signing & sealing of y.e same hath given granted bargained sold Aliened Enfeofed and Confirmed & by these p.rsents doth dully freely & absolutely Give grant Bargain sell alien Enffeoffe and Confirme unto y.e sd Thomas Smyth his heires and assigns for Ever all that parcell or tract of Land Called trampington Lying on the East side of Chesepieck Bay in Kent County being part of a Devident of Land Formerly belonging to M.r Thomas South and Conveyed from him y.e sd south to Anthony Pursee and John Hynson & since then purchased by M.r Nathaniell Euetts Being two hundred Acres as by a title of sale from y.e sd South Doth appeare a third part of w.ch two hundred Acres of a Land by y.e sd Phillip & mary Conner Doe warrant by y.e sd Thomas Smyth & his heires for Ever together w.th all rights proffitts & Benifitts thereunto belonging and allsoe all pattins Charters & Evidences touching or any wise conferning y.e same to have and to hold y.e sd pcell of Land & Bargayned permised by y.e sd Thomas Smyth his heires and Assignes for Ever y.e sd Phillip Conner and mary his wife to themselves there heires Excet.rs and Adm.rs doth promise & grant to give w.th the said Thomas Smyth his heires and Assignes that thay y.e sd Phillip Conner & Mary his wife there heires Execut.rs and Adm.rs y.e sd tract of land him y.e sd Thomas Smyth his heires and Assignes against all & Every maner of persons whatsoever shall and will ^for^ Ever after warrant & defend by these p.rsent the Lands and services hereafter to become due by y.e same to y.e Lord prop.ry in all wayes Excepted and foreprised and further that thay y.e sd Phillip Conner and Mary his wife there heires and assignes shall and will from tyme to tyme and att all tymes hereafter during the space of seven yeres att y.e Request & att y.e Charge and costs in ye same of him y.e sd Thomas Smyth his heires & assignes made doe acknowledge Execute and suffer or Cause to bee made Doue Acknowledged Executed and suffered all and Every such further & other act or acts thing or things service or Devices apureance or apuerances Requisite in the p.rmises for y.e better and firme Convaying & more here Makeing of y.e sd Bargayned p.rmises unto him y.e sd Thomas Smyth his heires or Assignes for Ever Bee itt by Inrolement of y.e p.rmises fyne testement or other wise or by any such Lawfull way or meane: as by him y.e sd Thomas Smyth his heires or assignes or y.e Councell Learned in in y.e Land shall bee Resonably Devised Advised or Required in Witness whereof y.e sd Phillip Conner & Mary his wife have hereunto sett there hands & seales y.e day & yeare above written Phill Conner sealed and Delivered in y.e p.rsence of Jon.o Hynson Mary M Conner Jon.o Downes |
