VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1808. 75

THE committee to whom was referred the petition of Thomas Layfield, of Worcester county, report, that
they have upon examination found the facts stated in the same to be true, but as provision is made by the act of
1795, chapter 81, to meet his case, they recommend that he have leave to withdraw his petition.

By order, N. MARTIN, clk.
Which was read the first and second time by especial order and concurred with.

The bill to authorise the levy court of Worcester county to assess and levy a sum of money for the purposes
therein mentioned, was read the second time, passed, and sent to the senate by the clerk.

On motion, the question was put. That the further consideration of the bill to alter, change and abolish, all
such parts of the constitution and form of government as relate to field-officers holding a seat in the general
assembly of this state, be referred to the next general assembly of Maryland? Resolved in the affirmative.

A petition from Samuel Gover, and others, praying a law may pass authorising the court of appeals to hear
and determine the case therein mentioned, was preferred, read, and referred to Mr. J. H. Thomas, Mr. Wilson,
Mr. Chapman, Mr. Herbert and Mr. Cottman, to consider and report thereon.

A petition from the owners of hack-stages, draymen, carters and labourers, of the city of Baltimore, stating
that they are deprived of employment by the interference of slaves, who engross the same, was preferred and
read, and the question put, That the same be referred to the consideration of, the next general assembly? The
yeas and nays being required, appeared as follow:

A petition from the officers and privates of the 35th and 38th regiments, of Queen-Anne's county, praying
additional meetings of regiments and battalions, was preferred, read, and referred to Mr. Spencer, Mr. Hop-
per and Mr. Wright, to consider and report thereon.

Mr. Davis, from the committee, delivers to the speaker a bill, entitled, An act authorising the inhabitants of
the lower end of Bush river neck, in Harford county, to erect a gate on the road leading thereto; which was
read the first and second time by especial order, and referred to the next general assembly.

A petition from sundry inhabitants of Baltimore and Harford counties, praying a road from David Lee's mill,
to intersect the post-road leading to Baltimore-town near the bridge at Onion's works, was preferred, read,
and referred to Mr. Stansbury, Mr. Forwood and Mr. Randall, to consider and report thereon.

Mr. Spencer, from the committee, delivers to the speaker a bill, entitled, An act for the relief of John. Hack-
ett, of Queen-Anne's county, an insolvent debtor; which was read the first time and ordered to lie on the table.

A petition from sundry inhabitants of Washington county, praying for a lottery for the purpose of building a
church in or near the village of Boonsborough, was preferred, read, and referred to Mr. Tilghman, Mr. Downey
and Mr. Bowles to consider and report thereon.

On motion, the question was put. That the further consideration of the additional supplement to the act, en-
titled. An act to prevent excessive gaming, be referred to the next general assembly of Maryland? The yeas
and nays being required, appeared as follow:

The house proceeded to the second reading of the same, and, on progression, the question was put, That
the further consideration of the same be referred to the next general assembly? Determined in the negative.

On further progression, the question was put, That the words " before a justice of the peace of the county
in which such winner or winners shall reside or. be found, " be inserted in the second clause after the word
" prosecuted ?" Determined in the negative.

On motion, the question was put. That the same be recommitted for amendment? Resolved in the affirmative.
ORDERED, That Mr, Mitchell and Mr. Parnham be added to the committee for that purposed
