88 VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1806

said Joseph Howard, Brice Howard and George Howard, giving bond, with security, to the state, to be ap-
proved by the said treasurer, to refund the aforesaid sum of seventy pounds sixteen shillings and six-pence, and
interest, agreeable to the tenor of said bill of credit, in case a certificate shall at any time hereafter be pro-
duced to the treasurer which issued from the treasury of the western shore, acknowledging that on the twenty-
seventh day of June, seventeen hundred and eighty, one Brice Howard paid into the treasury for Joseph How-
ard, and Company, the sum of two thousand eight hundred and thirty-three pounds six shillings and eight-pence,
by virtue of an act. of assembly of this state, passed at October session, seventeen hundred and eighty, entitled,
An ail for calling out of circulation the quota of this, state of the bills of credit issued by congress, and the
bills of credit emitted by acts of assembly under the old government, and by the resolves of convention.

THE house met.

The resolution in favour of George W. Mann was read the second time by especial order and unanimously
assented to.

The following resolution was read.

RESOLVED, That the governor and council be and they are hereby authorised and requested to have the room
usually occupied by the court of appeals furnished comfortably for the reception of the said court, and to draw
on the treasurer of the western shore for the expence thereof, who is hereby directed to pay the same.

The bill annulling the marriage of Juliana Cook and George Cook her husband, of the city of Baltimore,
was read the second time by especial order, and the question put, Shall the said bill pass? Determined in the
negative.

The question was then put, That the house adjourn? Determined in the negative.

The house proceeded to the second reading of the supplement to an act, entitled, An act for the relief of
sundry insolvent debtors, and after progression in reading the same, the question was put, That the further
consideration of the same be postponed until to-morrow? Resolved in the affirmative.

The bill to provide for the making an alteration in the road therein mentioned, was read the second time and
passed.

The following resolution was read.

Whereas this general assembly of Maryland, viewing with sensations of the greatest pleasure the brave and
gallant conduct of Charles Gordon, John Trippe and John Davis, in the several attacks on the enemy's gun-
boats off Tripoli, whereby they secured to themselves immortal glory, and gave a brilliant lustre to the navy of
the United Slates: And whereas this legislature feel an anxious wish to bear the most honourable testimony to
the bravery of these manly defenders of their country; therefore RESOLVED, That the governor and council
be and they are hereby authorised and required, to procure three elegant swords and belts, with an appropriate
engraving and motto, emblematic of the glorious actions fought off Tripoli, and cause the same to be delivered,
to the said Charles Gordon, John Trippe and John Davis, in testimony of the high sense of approbation the
legislature of this state entertain of their gallant conduct.

The following message was read and agreed to.

By the HOUSE of DELEGATES, January 2, 1807.
Gentlemen of the Senate,

WE perceive with regret that you have returned the resolution passed this house in favour of Jubb Fowler
dissented from. We flatter ourselves that on reconsideration you will agree to the resolution, especially when
you take into consideration the confidential situation in which he has been placed for twenty-five years past,
the faithful manner in which he has discharged the duties of his double station of door-keeper and messenger,
the labour incident to the discharge thereof, the advanced age of the memorialist, and the immense increase in
the expence of living since the establishment of his salary. We therefore return the resolution to you, in
expectation that on its reconsideration you will agree with us in opinion, that under all circumstances the addi-
tion proposed by us to the salary of the memorialist is but just and reasonable.

By order, J, BREWER, clk.

The bill to alter and change the times of holding the court of oyer and terminer and gaol delivery for Balti-
more county, was read the second time and passed.

The following message was read and agreed to.

By the HOUSE of DELEGATES, January 2, 1807.
Gentlemen of the Senate,

WE return you the bill, entitled, A supplement to an act authorising a lottery to raise a sum of money to
purchase a fire-engine, and to purchase ground and build a school-house, in Rockville, in Montgomery coun-
ty, and hope upon reconsideration, which we solicit, it will pass your house. Some of the commissioners
named in the law to which this is intended as a supplement cannot act, and without the supplement now wished
