44 VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1806.

The question was then put, That the words " who owns a musket or gun, " be inserted after the word ''pri-
vate" in the first part of said clause? Determined in the negative.

The question was then put, That the words "a musket or gun" be stricken out of the latter part of said
clause? Determined in the negative.

On further progression, the question was put, That the blank in the 20th clause after the words " that all
persons conscientiously scrupulous of bearing arms, and who shall refuse to do militia duty under this act, shall
pay the sum of, " be filled up with the words ' four dollars ?" The yeas and nays being required, appeared as
follow:

So it was resolved in the affirmative.

The question was then put, That, the words "provided nevertheless, that all such persons shall be subject to
a draught when required, and if draughted, to serve as such or find a substitute, as is provided for in other
cases by this act, " be inserted after the word " annually" in the first part of said clause? Determined in the
negative.

On motion, the question was put,: That the further, consideration of said bill be postponed until to-morrow?
Resolved in the affirmative.
The house adjourns until to-morrow morning 9 o'clock.

WEDNESDAY, December 10, 1806.

THE house met. Present the same members as on yesterday. The proceedings of yesterday were read.

On motion, ORDERED, That Mr. P. Stuart and Mr. Blakistone be added to the committee appointed on the
memorial of sundry inhabitants of Charles county.

Mr. Jackson, from the committee, delivers to, the speaker a bill, entitled, An act supplementary to an act
to provide for the organization and regulation of the courts of common law in this state, and for the administra-
tion of justice therein; which was read the first time and ordered to lie on the table.

The report of the committee on the petition of sundry inhabitants of Montgomery county was read the se-
cond time and concurred with.

Mr. Street, from the committee, delivers to the speaker he report on the petition of John C. Bond, as
amended; which was read.

Mr. Biggs, from the committee, delivers to the speaker a bill, entitled, An act to punish blasphemers, swear-
ers, drunkards and sabbath-breakers, and for repealing the laws heretofore made for the punishing such offend-
ers; which was read the first time and ordered to lie on the table.

A petition from Isaac Younger, of Kent county, praying a special act of insolvency, was preferred, read, and
referred to the committee appointed on petitions of a similar nature.

Mr. Denny, from the committee, delivers to the speaker a bill, entitled, A supplement to an act, entitled,
An act for the advancement of justice; which was read the first time and ordered to lie on the table.

ORDERED, That the same have a second reading on Thursday the 18th instant.

A petition from the commissioners and sundry inhabitants of Charles-town, in Caecil county, praying they
may be authorised to purchase a piece of ground in said town and to erect a house of public worship thereon,
was preferred, read, and referred to Mr; Moffit, Mr. Cox and Mr. Porter, to consider and report thereon.

Mr. Hawkins, from the committee, delivers to the speaker a bill, entitled, An act to authorise commissioners
to review the roads leading through the plantation of Henry Hershberger, of Frederick county; which was
read the first time and ordered to lie on the table.

A petition from sundry inhabitants of Baltimore county, praying an extension of the Falls turnpike, was
preferred, read, and referred to Mr. Aisquith, Mr. Shaaff, Mr. Little, Mr. Harryman and Mr. R; Steuart, to
consider and report thereon.

The house resumed the consideration of the bill to regulate and discipline the militia of this state; on pro-
gression, the question was put, That the blank in the 2nd clause be filled up with the words " one hundred?"
Determined in the negative.

The question was then put, That the said blank be filled up with the word " fifty?" Resolved in the affir-
mative.

On further progression, the question was put, That the blank in the 34th clause be filled up with the word
fifty?" Resolved in the affirmative.
