VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1806. 29

A petition from John Hunter, sheriff of Baltimore county, praying an alteration in the law relative to war-
rant executions, was preferred, read, and referred to Mr. R. Steuart,. Mr. Aisquith, Mr. Blakistone, Mr. W.
H. Brown and Mr. Harryman, to consider and report thereon.

Mr. Chapman, from the committee, delivers to the speaker the following report:
THE committee to whom was referred the petition of John Newton, a late soldier in the Maryland line during
the revolutionary war, report, that they have considered the same, and find that he served "in the army from,
sometime in June, 1780, to the end of the war, and from the appearance exhibited of a wound, they are satis-
fied of that fact as stated in his petition; they are therefore of opinion, that it should be the peculiar care of
this state to provide for the meritorious soldier, whose infirmities and afflictions have arisen from services faith,
fully rendered his country in the establishment of her independence and liberty, and recommend the following
resolution:.

RESOLVED, That the treasurer of the western shore be and he is hereby authorised and directed to pay to
John Newton, a late soldier in the Maryland line during the revolutionary war, or to his order, a sum of money
annually, in half yearly payments, as shall be equal to the half pay of a soldier while in the army of the United
States.

All which is submitted.

Which was read.

The house resumed the consideration of the report and resolution in favour of Robert Swails, and the ques-
tion was put, That the house concur with the said report, and assent to the resolution therein contained? De-
termined in the negative.

The clerk of the senate delivers the following message:

By the SENATE, November 29, 1806.
Gentlemen of the House of Delegates

WE have assented to the resolution regulating the election of two directors on the part of this state in the
Union Bank, and agree to go into the election on the day proposed in your message. Mr. John Walraven is put
in nomination by the senate, in addition to those named by you. Mr. Partridge and Air. Gibson will join the
gentlemen appointed by your house for the examination of the ballots.

By order, T. ROGERS, clk.

Which was read.

Also the bill for the relief of John Figg, of Montgomery county, endorsed " will pass. " Ordered to be en-
grossed.

The house proceeded to the second reading of the supplement to an act, entitled, An act to lay out and open
a public road in Hopkins's Neck, in Talbot county, by especial order; on motion, the question was put, That
the word " or" be inserted before the word " meadows?" Resolved in the affirmative.

The question was then put, That the words " or other enclosed or cultivated ground" be stricken out? Re-
solved in the affirmative.

On motion, the question was put, Will the house reconsider the first pan of said bill? Resolved in the affir-
mative.

The question was then put, That the words " cultivated grounds" be inserted after the word " orchards?"
Determined in the negative.

The bill being read throughout, the question was put, Shall the said bill pass? Resolved in the affirmative.

The house adjourns until Monday morning 9 o'clock.

MONDAY, December 1, 1806.

THE house met. Present the same members as on Saturday. The proceedings of Saturday were read.

Mr. Hebb and Mr. C. D. Hodges appear in the house.

The supplement to an act, entitled, An act to lay out and open a public road in Hopkins's Neck, in Talbot
county, was sent to the senate by the clerk.

A petition from sundry inhabitants of Talbot county, stating, that the want of literary institutions for the.
education of youth is great, and praying some provision may be made therefor, was preferred, read, and re-
ferred to the committee appointed to bring in a bill for the encouragement of learning.

A petition from Moor Falls, John M'Neale, and others, of the city of Baltimore, praying that part of a tract
of land called Salisbury Plains, may be sold for the benefit of the children of Stephen Wilson, deceased, was
preferred, read, and referred to Mr. R. Steuart, Mr. Little and Mr. Aisquith, to consider and report thereon.

Mr. Kerr, from the committee, delivers to the speaker a bill, entitled, A Further supplement to an act, enti-
tled, An act for the relief of the poor in Talbot county; which was read the first time and ordered to lie on the
table.

On motion, Leave given to bring in a bill, entitled, An act to confirm and make valid certain proceedings of
the orphans courts in different counties of this state, or of the justices thereof. ORDERED, That Mr. Bruce,
Mr. Briscoe and Mr. Davis, be a committee to prepare and bring in the same.
