VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1805. 87

On motion, the question was put, That Thomas M'Elderry" be stricken out of said section ? Determined
in the negative.

The question was then put, That " Henry Payson and William Jessop" be inserted in said section ? Resolved
in the affirmative.

The question was then put, Shall the said bill pass? Resolved in the affirmative.

On the second reading of the report on the petition of Martha Hall, the question was put, That the follow-
ing be added to the same, viz. " provided, that if it shall appear to the auditor that there are debts in the hands
of the citizen of this state due to the aforesaid William Mollison, survivor as aforesaid, liable to be affected
by said claim of Martha Hall, then in such case the auditor is hereby directed only to allow the said Martha
Hall the balance which may be due to her, deducting the amount of the debts so due to the said William Mol-
lison. " Resolved in the affirmative.

The question was then put, That the house concur with the said report and assent to the resolution therein
contained ? Resolved in the affirmative.

Mr. Stephen, from the committee, delivers to the speaker a bill, entitled, An act authorising the extension
of the Falls turnpike road to the Pennsylvania line; which was read the first time and ordered to lie on the table.

ORDERED, That the said bill have a second reading on Friday next.

The following resolution was read the first and second time by especial order and concurred with.

RESOLVED, That the treasurer of the western shore be and he is hereby authorised and directed to pay unto
Patrick Murdock, of Allegany county, or order, forty dollars, the same being in full compensation for lot 3876,
lying westward of Fort Cumberland, heretofore sold by the state, and to which the state can make no title.

Mr. Montgomery, from the committee, delivers to the speaker a bill, entitled, A supplement to the act, en-
tided, An act for the relief of sundry insolvent debtors, passed at November session, eighteen hundred and
three; which was read the first and second time by especial order and passed.

Mr. Ellicott, from the committee, delivers to the speaker a bill, entitled, An act to restrain the evil practices
of certain persons within this state; which was read the first time and ordered to lie on the table.

The report on the petition of Anthony Fox, of Anne-Arundel county, was read the second time and the re-
solution therein contained assented to.

The bill for erecting a town at or near the mouth of Will's creek, in Allegany county, was read the second
lime and passed.

The report on the petition of Hezekiah Speake, of Charles county, was read the second time and the reso-
lution therein contained assented to.

Mr. Moffit has leave of absence.

Mr. Shaaff, from the committee, delivers to the speaker the following report:

THE committee to whom the memorial of Jeremiah Townley Chase was referred, having taken the same
under consideration report, that for the reasons stated in the memorial they are of opinion that a compensation,
ought to be made to the memorialist; the committee therefore submit the following resolution:

RESOLVED, That the treasurer of the western shore pay to Jeremiah Townley Chase the sum of —— dollars,
out of any unappropriated money in the treasury.

Which was read.

A petition from David West, of Harford county, and William Foltz, of the city of Baltimore, praying that
commissioners of review may be appointed to lay off the road from the Black-house, past Myer's mill, on Lit-
tle creek, to Thomas Poteet's house, in a streight direction to the Pennsylvania line, was preferred, read, and
referred to Mr. Montgomery, Mr. Ayres and Mr. Forwood, to consider and report thereon.

Mr. Montgomery, from the committee, delivers to the speaker the following report:

THE committee to whom was referred the petition of Robert Elliott, of Harford county, a revolutionary
soldier, report, that they have taken the same under their consideration, and find the facts therein stated to be
true, and are of opinion that the prayer thereof ought to be granted; they therefore submit the following resolution:

RESOLVED, That Robert Elliott, a wounded revolutionary soldier, be and he is hereby entitled to receive,
during life, the half pay of a soldier in the Maryland line, and that the treasurer of the western shore pay the
same annually to the said Robert Elliott, or to his order, in quarterly payments.

By order, J. GOLDER, clk.
Which was read the first and second time by especial order and the resolution therein contained assented to.

The house proceeded to the reconsideration of the bill to establish permanent salaries for the judges of the
six judicial districts in this state; on progression, the question was put, That the first blank in the first enact-
ing clause be filled up with the words " two thousand two hundred?" The yeas and nays being required, ap-
peared as follow:
