VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1805. 69

THE committee to whom was referred the petition of Robert Halkerstone, of Charles county, late a lieute-
nant in the American army, report, that they have had the same under their consideration, and are well satis-
fied from the documents attending the same, together with the information communicated by several members
of the house of delegates, that the petitioner served in the late revolutionary war as a meritorious officer, and
that he has suffered considerable affliction from a wound which he received in the battle of German town, the
effects of which have rendered him totally incapable of supporting himself by his own exertions; they therefore
submit the following resolution:

RESOLVED, That the treasurer of the western shore be and he is hereby authorised and directed to pay annu-
ally unto Robert Halkerstone, of Charles county, or to his order, a sum of money equal to the half pay of a
lieutenant in the revolutionary war, in half yearly payments, and the said treasurer is hereby directed to ad-
vance one half year's allowance herein granted to the said Robert Halkerstone, on his application.

Which was read.

On motion, That leave be given to bring in a bill, entitled, An act relating to the equity jurisdiction of the
county courts of this state, and to abolish all such parts of the constitution and form of government as relate
to the high court of chancery, the question was put, That the further consideration thereof be postponed to
the next general assembly ? The yeas and nays being required, appeared as follow:

So it was resolved in the affirmative.

Mr. Street, from the committee, delivers to the speaker a bill, entitled, A supplement to the act, entitled,
An act to streighten part of the road in Harford county which leads from Underhill's mill to the city of Balti-
more; which was read the first time and ordered to lie on the table.

Mr. Merriken, from the committee, delivers to the speaker a bill, entitled, An act for the benefit of Robert
Williams, a free black man, and of his wife and children; which was read the first time and ordered to lie on
the table.

Mr. Ayres, from the committee, delivers to the speaker a bill, entitled, A supplement to the act, entitled,
An act to lay out and make a public road from the Black-house, in Harford county, to intersect the Pennsylva-
nia line; which was read the first time and ordered to lie on the table.

A memorial from Benjamin Harwood, of the city of Annapolis, praying that the auditor-general may be au-
thorised to state his account, allowing an interest of six per cent, on the amount of certain bills of exchange,
from the date of each bill respectively, and on the amount of the charges of protest, was preferred, read, and

referred to the committee appointed on the petition of sundry inhabitants of Pennsylvania and New-Jersey.

Mr. Stephen, from the committee, delivers to the speaker a bill, entitled, An act to authorise the drawing
of a lottery within the city of Baltimore for the purpose therein mentioned; which was read the first time and
ordered to lie on the table.

ORDERED, That the bill for the encouragement of learning in this state, and for other purposes, have a se-
cond reading on Tuesday the 6th instant.

The bill for the relief of Richard Gittings and Lambert Smith, of Baltimore county, insolvent debtors, was

read the second time and passed.

A petition from sundry inhabitants of Montgomery county, praying that the election for the first election dis-
trict in said county may be held at the town of Clarksburgh, and a petition from sundry inhabitants of said
county, praying that the election for Goshen district in said county may be held at Hughes's tavern, were
preferred, read, and referred to the committee appointed on the petition to alter the place of holding the elec-
tion in Thomas's district.

The amendments proposed to the further supplement to an act, entitled, An act to establish a market in Fre-
derick-town, in Frederick county, and for the regulation of the said market, were read the second time, agreed
to, and the bill ordered to be engrossed.

A memorial from William Gwynn, of the city of Baltimore, stating, that he purchased from the trustees of
John M'Lure lots No. 1 and 2, lying in the said city, that part of said lots are included in the ground laid out
for the court-house and prison, and that he is willing to pay for the same to Baltimore county, and praying that
the value thereof may be ascertained, was preferred, read, and referred to Mr. Stephen, Mr. Ellicott and Mr.
Harryman, to consider and report thereon.

The bill to declare what shall he evidence in certain cases therein mentioned, was read the second time and
passed.

The house adjourns until to-morrow morning 9 o'clock.
