58 VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1805.

A petition from sundry inhabitants of the city of Baltimore, praying a law to authorise a lottery to raise
4000 dollars to erect a church in said city, to be called Holy Trinity, was preferred, read, and referred to Mr.
Stephen, Mr. Montgomery and Mr. Carroll, to consider and report thereon.

The report of the committee on the petition of Marsham Parker, of Calvert county, was read the second
time, and the question put, Will the house concur with the said report, and assent to the resolution therein
contained ? The yeas and nays being required, appeared as follow:

So it was resolved in the affirmative.

On motion, Leave given to bring in a bill, entitled, An act to appoint wardens for the port of Baltimore. OR-
DERED, That Mr. Ellicott, Mr. Stephen and Mr. Harryman, be a committee to. prepare and bring in the same.

Mr. Montgomery, from the committee, delivers to the speaker a bill, entitled, An act to establish perma-
ment salaries for the judges of the six judicial districts in this state; which was read the first time and ordered
to lie on the table.

Mr. M'Pherson, from the committee, delivers to the speaker the following report:

THE committee to whom was referred the petition of Hezekiah Speake, of Charles county, report, that af-
ter an attentive examination into the facts, they find that the petitioner enlisted in the late revolutionary war,
and served as such for the term of three years, when he was regularly discharged; they also find that the de-
preciation on his pay, amounting to the sum of seventy-two pounds three shillings and two-pence, was settled
on the auditor's books on the sixth day of October, in the year seventeen hundred and eighty-three, and ap-
pears from the said books to have been drawn, but the committee feel well convinced from the documents exhi-
bited with the petition, (all of which establish the unimpeachable reputation and honesty of the petitioner, )
. that a fraud has been practised, and that he has never received the reward intended him by his country.
The committee further report, that the petitioner is poor, helpless and infirm, and as they feel anxious to alle-
viate the sufferings, and reward the meritorious services, of those who fought our battles and atchieved our in-
dependence, they recommend. the petitioner to the favourable notice of the house, and submit the following
resolution:

Whereas it appears to this general assembly that Hezekiah Speake, of Charles county, enlisted as a soldier

in the late revolutionary war, and faithfully acted in that capacity for three years, after which he was regularly
discharged, and that the depreciation on his pay, amounting to the sum of seventy-two pounds three shillings
and two-pence, was settled on the books of the auditor, and appears by them to have been drawn: And whereas

the general assembly believe that some fraud has been practised upon the said Speake, so that he never received
the reward intended him for his services, therefore, RESOLVED, That the treasurer of the western shore be
and he is hereby authorised and directed to pay unto the said Hezekiah Speake, of Charles county, the sum of

seventy-two pounds three shillings and two-pence, with interest thereon from the sixth day of October, seven-
teen hundred and eighty-three.

RESOLVED ALSO, That the said treasurer pay unto the said Hezekiah Speake, the sum of five pounds, due
him for one month and twenty days services, in guarding prisoners to Fort Pitt, after he was regularly dis-
charged from the army, with interest thereon from the tenth day of June, seventeen hundred and eighty.

Which was read.

The clerk of the senate delivers a letter from Samuel Chase, stating his claim as agent for the recovery of

the bank stock; which was read and referred to the committee appointed on a memorial from the said Samuel

Chase. The resolution in favour of John Sprigg Belt, and others, endorsed, " assented to. " And a bill, en-

titled, An act to confirm a division of the real property of the Havre-de-Grace company, endorsed, "will pass; "
which was read the first time and ordered to lie on the table.

Mr. Montgomery, from the committee, delivers to the speaker a bill, entitled, An act to provide for rendering
passable through Baltimore county the public road leading from the city of Baltimore by Belle-Air, in Harford

county, to Peach Bottom Ferry, on the river Susquehanna; which was read the first time and ordered to lie on
the table.

The house, according to the order of the day, proceeded to the second reading of the bill to alter, change
and abolish, all such parts of the constitution and form of government as establish religious tests as a qualifica-
tion for civil offices, and after sometime being spent in debating the same, the question was put, Shall the said
bill pass? The yeas and nays being required, appeared as follow:
