August Court 1726 is his good rule and Dignity and against the forme of the Act of Assembly in that Case made and provided &c M Howard Cler. pac. Testes John Sapp William Sapp W.m Boyer On the back of the preceeding Indictment as foll.s Viz.t A true bill by John Taylor foreman And the afd John Jones and Thomas Jones come in their proper persons and say that they nor either of them are not in any sort guilty of the premisses above upon them imposed as by the afd Indictm.t it is alleadged and of this they and either of them put themselves upon the Country John Jones & Thomas Jones in p.r p.r psons And he who follows for the Lord prop.ry in like manner saith that they and either of them are guilty M Howard p.r Lord prop.ry Thereupon Command was given to the Sherr of Kent County that he Imediately cause to Come here twelve &c.a by whome &c.a who neither &c to Recognize &c because as well &c of which said precept the said Sherr to wit Gideon Pearce Gent then high Sherr of Kent County here at that Day to wit the twenty second Day of March Anno Dom Seventeen hundred twenty & two makes return that he hath here ready twelve &c as by his precept he was Commanded And now here afterwards to wit the Day and year last Mentioned Came again the afd Lord prop.ry by Michael Howard his Clerk of Indictments and the afd John Jones & Thomas Jones in their proper persons and the Jourors of that Jury being Impannelled and Called likewise Came to wit Thomas Christian Richard Kennard Humphry Younger James Thomas Roger Hales Rich.d Davis Francis Meeks Griffith Jones Abraham Ambrose John Walls John Jones and John Brookes who being duely Elected tryed and Sworn to say the truth on the premisses upon their Oath do say that John Jones and Thomas Jones and either of them are guilty of the premisses above upon them Imposed as by the afd Indictment it is alleadged Thereupon Michael Howard Gent Attorney of the said Lord prop.ry prays Judgment on |
