CHAP. 284.

ation by the said commissioners or any of them, and shall
notify within one month the same to the said commission-
ers in writing, it shall and may be lawful for said commis-
sioners or any two of them to issue their warrant to the
Sheriff of the county, commanding him to summons as
jurors, six disinterested men qualified to serve as jurors in
the county court, to appear on a day by them to be appoin-
ted on the premises; and the said commissioners, or any
one of them are hereby authorised to administer an oath or
affirmation, as the case may be, to every person so sum-
moned, that he will without favour, affection, partiality or
prejudice, assess the damages sustained by the person or
persons at whose request such inquisition shall be taken,
by transfer of his, her or their land about to be made as
aforesaid, and the persons so summoned and so qualified,

shall proceed to value the damages accordingly, and such
inquisition shall be conclusive and final; provided, that in
such appeal from the valuation made by the commission-
ers, should the valuation of said commissioners be con-
firmed or reduced by the jury, by this section directed to
be summoned, the party appealing shall pay the whole ex-
pense incurred thereby.

Sec. 3. And be it enacted, That the commissioners and
jurors aforesaid, shall be allowed for each and every day
they shall be employed, under the provisions of this act
two dollars and costs necessarily incurred, to be collected
and paid as other county charges are.

Copy of proceed-

ings

Sec. 4. And be it enacted, That the commissioners as afore-
said, if there be no appeal from their decision within one
month after said decision is made, or jurors, if there be an
appeal, when they shall have completed their valuation, and
done all things required of them by this act, shall make
out a copy of their proceedings, setting forth in the same,
a full description of the lands and house by them valued,
for the use of the ferry or ferries, and all things connected
with the said valuation, and the performance of the duties
assigned them by this act, and to the said copy they shall
subscribe their names, and set their seals, and deposit the
same in the office of the clerk of the county court, and the

said clerk of the said court shall preserve a record of the
said proceedings, for the recording of which he shall be
entitled to the same fee, which he receives for other re-
cords, to be paid by the Levy court.
