CHAP. 24.

hereby authorized and required, on receiving from the Com-
missioners an account, on-oath, of the said expenses, inclu-
ding an allowance of two dollars per day, to the Commis-
sioners, for their services, to levy the sum in proportion

Sec. 3. And be it enacted, That the Commissioners, or
a majority of them, shall value and ascertain the damages
that may be sustained by any person or persons, through
whose land the said Road may be made to pass, taking
into consideration the advantages and disadvantages, if any,
and the damages so ascertained shall be levied, and assess-
ed as other county charges in said counties are, and shall
be paid by the county wherein such damages may be sus-
tained.

Sec. 4. And be it enacted, That the said Commissioners,
before they proceed to act, shall take an oath or affirmation
before some Justice of the Peace, that they will, without fa-
vor, partiality, or prejudice, assess the damages sustained
by the persons through whose land the said Road may pass.

An act to Incorporate the Hagerstown Savings Institution
in Washington County.

Section 1. Be it enacted by the General Assembly of
Maryland, That David G. Yost, William D. Macgill, Wil-
liam Price, William Wise, Jonathan Hager, William H.
Fitzhugh, George Brumbaugh, Alexander Neile, William
D. Bell, Daniel Willyiard, Jacob S. Smith, David Show-
man, David Arty and Martin Newcomer, and all and every
other person or persons hereafter becoming members of
the "Hagerstown Savings Institution," to be located in
said town in the manner hereinafter mentioned, shall be,
and are hereby created and made a corporation and body
politic by the name and style of "The Hagerstown Savings

Institution," and by that name shall have succession, and
be capable by law to hold and dispose of real and personal
property by deed or otherwise; to sue and be sued, plead
and be impleaded, answer and defend, and be answered
and defended in courts of law and equity, or in any other
place whatsoever, and to receive and make all deeds, trans-
fers, contracts, covenants, conveyances and grants what-
