CHAP. 158.

CHAPTER 157.

Passed Mar. 12, 1833

An act relating to certain trespasses upon real estate.


Section 1. Be it enacted by the General Assembly of
Maryland, That from and after the first day of May next,
it shall and may be lawful for any person aggrieved by the
trespass upon his inclosures,of any horned or black cattle,
hogs or sheep, in the possession or care of any person
without the jurisdiction of this State, to impound the
same, and have the damages sustained by reason of such
trespass, valued on oath, by two disinterested citizens of
his county, and at the expiration of ten days, inclusive of
the day he impounds the same and the day of sale, pro-

bidder, for cash, and after deducting from the proceeds of .
such sale, the amount of damages valued to him, and a
reasonable compensation for feeding the same while in
pound, he shall pay over the residue, when demanded, to
the legal owner of said property so impounded and sold,
or his agent.

Sec. 2. And be it enacted, That it shall be the duty of
the parry aggrieved,before making sale as aforesaid, to ad-
vertise not less than eight days before the sale, at three of
the most public places in his neighborhood, a description
of the property impounded by him, the time and place of
sale; and also in said advertisement to warn the owner to

come forward and pay the damages and compensation for
feeding the same, and take his property; provided, that up-
on tender being made to the party aggrieved by the trespass,
of the amount of damages and a reasonable compensation
for his feeding the property impounded, it shall be his duty
at any time before the sale is made thereof, to deliver the
same to the proper owner or his agent.
