CHAP. 142.

damages which maybe sustained as well as the advantage's
by the owner or owners of said land, and make true inqui-
sition and return of the amount of damages which maybe
sustained by the owner or owners of said land, under their
hands and seals, to the justice who issued the warrant, and
that the decision of the said jurors shall be final; Provided,
that the said turnpike road shall not pass through the
house, yard, grist mill, or saw mill of any person.


Sec. 7. And be it enacted, That upon the President and
Directors paying to the owners of the land lie sum so
awarded by the jurors aforesaid, as the case maybe, they
shall have power to cut, dig ar.d make the turnpike road
aforesaid, through such land in the same manner as if the
consent of the owner had been given thereto, and that the
said President and Directors be empowered to erect and
make bridges and viaducts over all such streams, or water
courses as may be thought necessary for the benefit of said
Turnpike Road, so as not to obstruct the free current of
said streams or water courses.

Sec. 8. And be it enacted, That this act shall be in full
and perpetual force; Provided, that the work contemplat-
ed to be executed and made by the provisions of this bill,
shall be commenced within three years from the passage
of this act, otherwise all right intended to be given and
secured by this act, shall be null and void.

Keeping road in

Sec. 9. And be it enacted, That if at any time the said
road or any part thereof, shall, by omission or neglect of
said company or their agents, not be kept in regular good
order, then and in that case, upon application being made
to a justice of the peace, in and for said county, he shall be
authorized to issue his warrant, directed to any constable,
sheriff, or deputy sheriff, requiring the . gates on said road
to be thrown open, free from the collection of toll, and so
remain until the state ,and order of the road is reinstated
to reasonable and original order.


CHAPTER 142.

Passed Feb. 27,1833

An ad to repeal an act, entitled, an act to abolish Imprison-
ment for Debt, on certain judgments rendered by Justices
of the Peace, passed at December session, eighteen hun-
dred and thirty, chapter one hundred and fifty-five.

Act repealed.

Be it enacted by the General Assembly of Maryland,
That from and after the passage of this act, the act, enti-
