June Court 1761 89 Case Provided &c Whereupon the Said Samuel Horsey at the Prayer of the afd. Sampson Wheatly is Adjudged to give Special Bail to the Action afd. Thereupon a Certain Stephen Horsey of Somerset County planter present here in Court in his proper person undertook for the Said Samuel Horsey that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said Sampson Wheatly Against the afd. Samuel Horsey or that he the Said Samuel Horsey Should be therein Convict that then he the Said Samuel Should pay and Satisfie unto the afd. Sampson Wheatly the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the Prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said Stephen Horsey will do the Same for him &c And the afd. Samuel Horsey by William Hayward his Attorney Comes and defends the force and Injury when &c. And prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of June next following and he hath it and the Same day is given to the afd. Sampson here also &c. Att which day here Came as well the afd. Sampson Wheatly as the afd. Samuel Horsey by their Attorneys afd. And hereupon the Said Samuel as before defends the force and Injury when &c. And Saith that he Cannot deny the Action afd. of the afd. Sampson Wheatly nor but that the Writing Obligatory afd. is the deed of him the afd. Samuel Horsey nor but that he Oweth the Same Sampson the afd. Eighteen pound Six Shillings and Nine pence Curt Money in Manner and form as the afd. Sampson above Against him hath declared Therefore is Considered that the afd. Sampson Wheatly Recover Against the afd. Samuel Horsey his Debt afd. and his Damages by Occasion of the detention of that Same 493 debt to Pounds of Tobacco to the Same Sampson of his Assent by the Court here Adjudged And the afd. Samuel in Mercy &c.
the Parish afd. in the County afd. with force and Arms in and upon a Certain John Keeves in the peace of God and the Said Lord Propry then and there being an Assault did Make and him the Said John then and there did Beat Wound and Evilly treat so that of his Life it was Much dispaired and Other harms to him the Said John then and there did to the Great Damage of the Said John and Against the peace of the Right Honrble the Lord Propry that now is his Good Rule and Government and So forth On the Back of the foregoing Bill of Indictment it was thus Endorsed Vizt No Bill Jarvis Ballard foreman Test. Evidences on behalf of a Certain Esther Tull and Benton Harris of Somerset County in Relation to the Bounds of a tract of Land Called Bear Point or the Bounds of Any other Land on which the Same may depend We therefore Require you or Any three or two of you at Some time and Place as to You or Any three or two of You it Shall Seem Convenient You meet on the afd. Land Called (Bear Point or Any other Lands on which the Bounds of the afd. Land may depend You first haveing taken Your Oaths on the holy Evangels of Almighty God and there Cause to Come before you or Any three or two of You all Such Evidences as Shall be to You or Any three or two of You Nominated by the Said Complainant or Deft. and that You or Any three or two of You Examine them upon their Corporall Oaths to be by you or Any three or two of You Administred on the holy Evangelist of Almighty God in the Presence of the Complainant or Deft. if Any touching the truth or Remembrance of their knowledge or Any thing that may Relate to the Cause afd. and that Reduceing the Severall Depositions into Writing You Send the Same with this our Commission under your or Any three or two of Your hands and Seals to us to our County Court of Somerset with all |
