June Court 1761 90 all Convenient Speed Wittness Isaac Handy Esqr. one of our Justices of our Said Court the 22d day of November in Anno Dom. 1760 And now to witt at a Court of his Lordship held at Princes Ann Town the third Tuesday of June One Anno Dom. one thousand Seven hundred and Sixty ^ before the Justices thereof Came Thomas Jones and Edward Waters Two of the Gentlemen Nominated in the Within Commission and Returned the Same Endorsed in Manner following with the Severall Depositions thereto Annexed March ye. 18th 1761 This day was Mr. Thomas Jones Qualified to Execute the within Commission before Ephm. Wilson May the 1st 1761 Then was Edward Waters Senr. Qualified upon the within Commission Before Th. Jones May 30th 1761 Then was the within Commission Executed at which Time Isaac Costen Entred himself defendant The Execution of the within Commission Appears by the Severall Depositions hereunto Annexed Taken by Thos. Jones Edward Waters Comrs. The Deposition of James Knight of Somerset County Aged forty Eight Years or their Abouts being Sworn on the holy Evangelist of Almighty God Saith that he Sundry times Saw a Black Gumb Marked as a Bounder Standing in a thicket of Wood to the Westward and about An hundred Yards distant from Dividing Creek which tree this Deponant was informed by Comfort Benton and John Harris was a Bounder tree of a tract of Land Called Bear Point which Land the Said Harris and Benton were then in Possession of and this deponant further Saith that the afd. Gumb was Commonly deemed by all the Neighbours Adjacent to be the Bounder of the afd. Land Called Bear point Which tree stood in the spot where a Course Bears South Sixty Eight degrees East thirty nine Perches distant from the South East Corner of Isaac Costons Dwelling house and also a Course Bearing South Eighteen degrees East Twenty four perches distant from a Hickory Notched on three Sides and further Saith not James Knight The Deposition of Hannah Riggen of Somerset County Aged forty One Years or thereabouts being Sworn on the holy Evangelist of Almighty God Saith that when She was a Girl She Sundry times Saw a Black Gumb which Appeared to be marked Standing in a thicket of Wood a Little distance to the Northward of a Small Gully Issuing from dividing Creek which tree this Deponant Saith She was often Shewed by her Father and Mother and told by them that the Same was a Second Bounder of a tract of Land Called Bear Point and a Corner tree of a tract of Land Called Costons Trouble which which tree Stood in the Spot where A Course bears South Sixty Eight degrees East thirty Nine Perches distant from the South East Corner of Isaac Costons dwelling house and also where a Course Bears South Eighteen degrees East Twenty four perches distant from a Hickory Notched on three Sides and further Saith not Hannah Riggen The Deposition of Joseph Riggen of Somerset County Aged Sixty One Years or thereabouts being Sworn on the holy Evangelist of Almighty God Saith that about Twenty Years past he was Informed by Isaac Coston and Comfort Benton that the Bounder of the Said Isaac Land Stood in Dividing Creek and further Saith not Joseph Riggen The Deposition of Gideon Tilman of Somerset County Aged Seventy Eight Years or there about being Sworn on the holy Evangelist of Almighty God Saith that About fifty Years past he was Imployed as A Chain Carrier when William Whittington who was then the Surveyor was Called upon by Stephen Coston to divide Some Lands between him and his Mother and Beginning at a Poplar being the first bounder of a tract of Land Called Costons trouble and in Running the first Course of Said tract it Carried them into Dividing Creek at which time Comfort Benton the Mother to the Said Coston being Present found fault with the Surveyor and Said he was Wrong for She Said the Gumb Bounder Stood by the Creek and further Saith not taken this 30th day of May Anno
