Somerset County Judicial Records, 1760-1763

Dennis Gent. now here Returned that he had taken the af^d. John Watkins whose body here at this day he had Ready to
Answer the af^d. Thomas Holbrook of the af^d. plea as to him it was Commanded
      Whereupon the Said John Watkins put in his place William Allen Gent. Attorney at Law Against the af^d.
Thomas Holbrook of the af^d. plea
      And thereupon at the Prayer of the Parties af^d. day is to them now here given untill next Court to be held at
Princes Ann Town the third Tuesday of November then next following in the State that now Saveing to the parties af^d.
      Att which day here Came the Parties af^d. by their Attorneys af^d. And hereupon the Said Thomas Holbrook
Complained of the af^d. John Watkins in the plea af^d. in form following
Somerset fs^t John Watkins Late of Somerset County Blacksmith was Attached to Answer unto Thomas
Holbrook of a plea of trespass upon the Case and So forth
      And Whereupon the Said Thomas by W^m. Hayward his Att^y Complains that whereas the Said John the
day of            Anno Dom. MDCCL       at Somerset County af^d. was Indebted unto the Said Thomas in the Sum of
Three pound fifteen Shillings Cur^t Money of Maryland for So much Money by the Said John of the Said Thomas before
that time had and Received and So thereof Indebted being the Said John in Consideration thereof Afterwards to witt
the Same day and Year af^d. at the County af^d. upon himself Assumed and to the Said Thomas then and there faithfully
Promised that he the Said John the Sum of Money af^d. when he Should be thereto Required well and faithfully would
pay and Content Nevertheless the Said John his Promise and Assumption af^d. in form af^d. made Little Regarding
but minding and fraudulently Intending the Said Thomas in that Part Craftily and Subtilly to deceive and defraud the
Sum of Money af^d. unto the Said Thomas hath not paid or him for the Same in Any Sort Contented (Altho the Same to do
the same John Afterwards to witt the Same day and Year af^d. and often Since at the County af^d. by the Said Thomas was
Required) but the Same to him to pay hitherto Altogether hath Refused and Still doth Refuse and unjustly
deny Whereupon the Said Thomas Says he is Worse and hath Damage to the Value of Ten pounds Cur^t Money of
Maryland and thereof he brings Suit and So forth                           Pledges &^c. J: Doe & R: Roe
And the af^d. John Watkins by his Attorney af^d. Comes and defends the force and Injury when &^c. And prays Leave thereof
to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of March then next following and he
hath it and the Same day is given to the af^d. Thomas Holbrook here also &^c
      Att which day here Came as well the af^d. Thomas Holbrook as the af^d. John Watkins by their Attorneys af^d.
And hereupon the Said John as before defends the force and Injury when &^c. And Saith that he Cannot deny the Action
af^d. of the af^d. Thomas Holbrook nor but that he did Assume upon himself in Manner and form as the af^d. Thomas above
Against him hath Complained and as to the Damage of the Same Thomas by him by Occasion of the Premisses in that part
Sustained the Same John Saith and Acknowledgeth that the af^d. Thomas hath Sustained Damages by Occasion of the
Premisses beyond his Costs and Charges by him about his Suit in that part Apposed to three pounds fifteen Shillings Cur^t Money
and not More and because the af^d. Thomas denys not this but the Same Allegation Grants to be true prays Judment for
those Damages above Acknowledged together with his Costs and Charges af^d. to him to be Adjudged &^c.
      Therefore by Consent of the Parties af^d. it is Considered that the af^d. Thomas Holbrook Recover Against
the af^d. John Watkins his Damages af^d. to the af^d. three pounds fifteen Shillings Cur^t Money by the Said John in form af^d.
712    Acknowledged as also P                                Pounds of tobacco for his Costs and Charges af^d. to the Said Thomas
at his Request by the Court now here of the Assent of the Parties af^d. Adjudged which Certain Damages in the Whole
Amount to three Pound fifteen Shillings Cur^t Money and                                Pounds of Tobacco and
the af^d. John in Mercy &^c.

@    Command was given to the Sheriff of Somerset County that he Should Take William Bailey

LD    W^m. Baly    Late of Somerset County Planter Otherwise Called I W^m. Baily if he Should be found in his Bailywick and him

Should Safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at
Princes Ann Town the third Tuesday of November Anno Dom. One thousand Seven hundred and Sixty to Answer
unto W^m. Geddes of A plea that he Render unto him the Sum of Seventeen pounds ten Shillings Cur^t Money of Maryland which
to him he Owes and unjustly Detains &^c And the Same day is given to the af^d. Geddes here &^c
      Att which day here Came the af^d. W^m. Geddes by W^m. Hayward his Att^y and the Sheriff to witt John Dennis Gent.
