March Court 1761 80 now here Returned that he had taken the afd. Wm. Baly whose body here at this day he had Ready to Answer the afd. William Geddes of the afd. plea as to him it was Commanded Whereupon the Said William Baly at the prayer of the afd. Wm. Geddes is Adjudged to give Special bail to the Action afd. Thereupon a Certain George Baly of Somerset County Planter present here in Court in his proper person undertook for the Said Wm. Baly that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said William Geddes Against the afd. Wm. Baly or that he the Said Wm. Baily Should be therein Convict that then he the Said William Baily Should pay and Satisfie unto the afd. Wm. Geddes the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the Prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said George Baly will do the Same for him &c Whereupon the Said Wm. Baily Puts in his place Littleton Dennis Gent. Attorney at Law against the afd. Wm. Geddes of the afd. plea And thereupon at the Prayer of the Parties afd. day is to them now here given untill next Court to be held at Princes Ann Town the third Tuesday of March then next following in the State that now Saveing to the Parties afd. &c. Att which day here Came the parties afd. by their Attorneys afd. And hereupon the Said Wm. Geddes Declared Against the afd. Wm. Baly in the plea afd. in form following Somerset fst William Baily Late of Somerset County Planter Otherwise Called I William Baly was Summoned to Answer unto William Geddes of A plea that he Render unto him the Sum of Seventeen pound & Ten Shillings Curt Money of Maryland which to him he Owes and unjustly Detains and So forth And Whereupon the Said William Geddes by William Hayward his Attorney Says that Whereas the Said William Baly on the xv day of Aprill Anno Dom. MDCCIX at Somerset County afd. by his Certain Writing Obligatory which the Said William Geddes with the Seal of the Said Wm. Baly Sealed here to the Court Shews whose date ist he Same day and Year afd. Acknowledged himself to be held and firmly bound unto the Said William Geddes in the Sum of Seventeen pounds and Ten Shillings Curt Money of Maryland to be paid to the Said Wm. Geddes when he the Said William Baly Should be thereto afterwards Required Nevertheless the afd. Wm. Baily tho often thereto Required the afd. Sum of Seventeen Pounds and Ten Shillings Curt Money of Maryland unto the Said Wm. Geddes hath not paid but the Same to him to pay hitherto Altogether hath Refused and Still doth Refuse and unjustly Detain Whereupon the Said William Geddes Says he is Worse and hath Damage to the Value of Seventeen pounds and Ten Shillings Curt Money of Maryland & thereof he brings Suit and So forth Pledges &c. J. Doe & R. Roe And the afd. William Baily by his Attorney afd. Comes and defends the force and Injury when &c. And Saith that he Cannot deny the Action afd. of the afd. Wm. Geddes nor but that the Writing Obligatory afd. is the deed of him the Said Wm. Baly nor but that he Oweth the Same Wm. Geddes the afd. Seventeen pounds and Ten Shillings Curt Money of Maryland in Manner and form as the afd. Wm. Geddes above Against him hath declared Therefore it is Considered that the afd. Wm. Geddes Recover Against the afd. Wm. Baily his Debt afd. and his Damages by Occasion of the detention of that Said 195 Debt to Pounds of Tobacco to the Same Wm. Geddes of his Assent by the Court here Adjudged And the afd. Baily in Mercy &c
Princes Ann Town the third Tuesday of November Anno Dom. one thousand Seven hundred and Sixty to Answer unto Outerbridge Horsey of a plea that he Render him the Sum of three pounds Two Shillings and Six pence Curt Money of Maryland which to him he Owes and unjustly detains and So forth And the Same day is given to the afd. Outerbridge here &c And hereupon the Said Outerbridge Horsey Declared Against the afd. William Tully in the plea afd. in form following Somerset fst William Tully Late of Somerset County Planter Otherwise Called William Tulley was Summoned to Answer unto Outerbridge Horsey of a plea that he Render him the Sum of three pounds Two Shillings and Six pence Curt. Money of Maryland which to him he Owes and unjustly detains and So forth And Whereupon the Said Outerbridge by Wm. Hayward his Atty Says that Whereas the Said William Tully on the xx day of January Anno Dom. MDCCLViii at Somerset County afd. by his Certain Bill Obligatory which the Said Outerbridge |
