March Court 1761 75 much dispaired and Other harms to him the Said Samuel then and there did to the Great Damage of the Said Samuel And Against the peace of the Right Honrble the Lord Propry that now is his good Rule and Government and So forth Thereupon it is Commanded the Sheriff of Somerset County that he Should Take the Said Thomas Hayward Junr. if &c. to Answer &c. And now to witt at a Court of his Lordship held at Princes Ann Town the third Tuesday of March Anno Dom. 1761 before the Justices thereof Came the afd. Thomas Hayward Jur. in his proper person according to A Certain Recognizance by him and his Security in this part before Acknowledged and had a hearing of the Indictment afd. Saith that he will not Contend with his Lordship but for the Saveing Costs Labour and Expences About the premisses Submits himself at fine with his Said Lordship by Occasion of the premisses and put himself upon the faviour of the Court &c Whereupon all and Singular the premisses being Seen and by the Court fully understood it is Considered by the Court here that the afd. Thomas Hayward Jur. for the premisses and Offence afd. in the Indictment afd. Above Specified be taken which ten Said Thomas Hayward Jur. present here in Court as afd. is fined for the premisses and Offence afd. ^ his Lordship Maryland which he paid here in Court to the use of ^

Scituated Feloniously did Break and Enter and One White Linnen Shirt of the Value of Two Shillings One Oznabrig Bag of the Value of Six pence Two pieces of Brown Shalloon of the Value of Ten Shillings Each piece One piece of Brown Fustin of the Value of Ten Shillings, Six Yards of Russia Drab of the Value of One Shilling Each Yard Seventeen Yards of Bedtick of the Value of Ten Shillings Eight Yards of Corse white Linnen of the Value of One Shilling Each Yard One Dozen of Checked Linnen Handkerchiefs of the Value of One Shilling Each handkerchief four papers of pins of the Value of Six pence Each paper four yards of Cotton Check Linnen of the Value of One Shilling Each Yard Two Dozen of Ferrit Laces of the Value of One penny Each Lace Eight Dozen of White Vest Wire Buttons of the Value of four pence Each Dozen thirteen Yards of Silk poplin of the Value of One Shilling Each Yard four Caster hats of the Value of five Shillings Each Hat Two felt Hats of the Value of One Shilling Each Hat and Six Yards of Welsh Cotton of the Value of One Shilling Each Yard of the Goods and Chattles of the afd. Stephen Garland in the Same Store house then and there being found then and there feloniously did Steal take and Carry away And the Jurors afd. upon their Oath afd. do further Present that Negro Kate Late of Somerset Parish in the County afd. Spinster the Slave of a Certain Hamilton Bell on the afd. Twenty first day of December in the Year of our Lord One thousand Seven hundred and Sixty and after the afd. Negro Liverpool his Felonious Breaking the Store house afd. And the Felonious takeing and Stealing of the Severall Goods and Chattles afd. with force and Arms at the Parish of Somerset in the County afd. the Several Goods and Chattles afd. Knowing them to be Stolen goods from the afd. Liverpool Feloniously did Receive and Secret Against the piece of his Lordship the Right Honrble the Lord Propry that now is his Good Rule and Government &c. Thereupon it is Commanded the Sheriff of Somerset County that he Should Take the Said Negro Kate if &c. to Answer &c. And Now to witt at a Court of his Lordship held at Princes Ann Town the third Tuesday of March Anno Dom. one thousand Seven hundred and Sixty One before the Justices thereof Came the afd. Negro Kate in her proper person According to A Certain Recognizance by her Security in that part before Acknowledged and being Brought to the Barr is Committed to the Sheriff of the County afd. And the Said Kate forthwith Concerning the premisses in the Said Indictment above Specified and and Charged on her as above being Asked how She of the felony afd. would thereof Acquit herself Saith that She is in noe Sort thereof Guilty and thereupon of good and Evill puts herself upon the Country Therefore Let the Jury thereupon Immediately Come before the afd. Justices and who are of no Affinity to the Said Negro Kate to Recognize upon their Oath whether the Said Negro Kate is Guilty of the felony in the Indictment afd. or not And the Jurors of that Jury by the Said Sheriff to this Matter Impannelled and Returned to witt George Irving, William Pollit, Marcy Beauchamp, George Day Scott, Geo. Wails, Michael Dorman, Zorobable King Wm. McClemey, Wm. Hath, James Polk, William Fleming and John Anderson being Called Came who to Say the truth of the premisses afd. being Elected tryed and Sworn upon their Oath Say that the afd. Negro Kate is not Guilty of the Premisses in the Indictment afd. Above Specified in Manner and form as the afd. Negro Kate by pleading hath alledged Thereupon it is Considered by the Court here that the Said Negro Kate of the premisses afd. |
