found in his Bailywick and her Should Safe keep so that he might have her body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town the third Tuesday of March Anno Dom. one thousand Seven hundred & Sixty One to Answer unto his Lordship of and Concerning the presentment afd. &c Att which day here Came the afd. Mary Milbourn in her proper person and had a hearing of the presentment afd. Saith that She Cannot deny but that She is Guilty of the premisses in the presentment afd. Above upon her Imposed in Manner and form as by the presentment afd. Above Against her Supposed and maketh Oath that William Smart is the father of the Child She Stands presented for &c Whereupon all and Singular the premisses being Seen and by the Court fully understood it is Considered by the Court here that the afd. Mary Milbourn for the premisses and Offence afd. in the Presentment afd. Above Specified be taken &c. which Said Mary Milbourn is fined for the premisses and Offence afd. thirty Shillings Curt Money of Maryland which was paid here in Court to the use of the County &c.
afd. in the County afd. in and upon a Certain Esther North in the peace of God and the Said Lord propry then and there being an Assault did make and her the Said Esther then and there did beat wound and Evilly treat so that of his Life it was much dispaired and Other harms to the Said Esther then and there did to the Great Damage of the Said Esther and Contrary to the peace of his Said Lordship that now is his good Rule and Government &c. Thereupon the Sheriff of Somerset County is Commanded that he Should Take the Said John Godard if he Should be found in his Bailywick and him Should Safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town the third Tuesday of November Anno Dom. one thousand Seven hundred and Sixty to Answer unto his Lordship of and Concerning the Indictment afd. Att which day here Came the afd. John Godard in his proper person and had a hearing of the Indictment afd. Saith that he is not thereof Guilty and for tryall thereof puts himself upon the Country and Wm. Hayward Gent. his Lordships Attorney who for his Said Lordship in this part prosecuteth in Like manner Thereupon it is Commanded the Sheriff of Somerset County that he Should Cause to Come before his Lordships Justices at the next Court to be held at Princes Ann Town the third Tuesday of March then next following Twelve good and Lawfull men of his Bailywick by whom the truth of the premisses may be the better known and who are of no Affinity to the Said John Godard to Recognize upon their Oath if the Said John Godard be Guilty of the premisses afd. or not because as well the afd. William Hayward his Lordships Attorney who for his Said Lordship in this part prosecuteth as the afd. John Godard have put themselves upon that Jury Att which Said Third Tuesday of March Anno Dom. 1761 Came as well the afd. Wm. Hayward Gent. his Lordships Attorney who for his Said Lordship in this part prosecuteth as the afd. John Godard in his proper person and the Said John Relinquished his Averment afd. Saith that he will not Contend with his Said Lordship but for the Saveing Costs Labour and Expences About the premisses Submits himself at fine with his Said Lordship by Occasion of the premisses and put himself upon the favour of the Court Whereupon all and Singular the premisses being Seen and by the Court fully understood it is Considered by the Court here that the afd. John Godard for the premisses and Offence afd. in the Indictment afd. Above Specified Two and Six pence be taken &c. Which Said John Godard is fined for the premisses and Offence afd. ^ he paid to the Sheriff for the use of his Lordship &c.
the Said Lord Propry his Justices of the Same County Court and for the Same Lord Propry doth Give the Same Justices here to understand and be Informed that Sarah Dashiell Late of Stepney Parish in the Said County of Somerset Spinster the first day of March in the year of our Lord One thousand Seven hundred and Sixty at the Parish afd. in the County afd. did Commit fornication with a Certain Person unknown and did permit the Same unknown person to have Carnal knowledge of her body |
