And the afd. Thomas Newbold in Custody as afd. Comes and Defends the force and Injury when &c. And prays Leave thereof to
Imparle here untill next Court to be held at Princes Ann Town in and for the County afd. the third Tuesday of March then next
following and he hath it And the Same day is given to the afd. Gale and Ponsonby here also &c.
         Att which day here Came as the the afd. Gale and Ponsonby by their Attorney afd. as the afd. Thomas Newbold in Custody
afd. And hereupon the Said Thomas as before defends the force and Injury when &c. And Saith that he Cannot deny the Action
afd. of the afd. Gale and Ponsonby nor but that he did Assume upon himself in Manner and form as the afd. Gale and Ponsonby
Above Against him have declared and as to the Damage of the Same Gale and Ponsonby by him by Occasion of the
Premisses in that part Sustained the Same Thomas Saith and Acknowledgeth that the afd. Gale and Ponsonby have Sustained
damages by Occasion of the Premisses beyond his Costs and Charges by him About his Suit in that part Apposed to Six pounds Six
Shillings and Seven pence three farthings Curt Money and not More and because the afd. Gale and Ponsonby deny not this but
the Same Allegation Grant to be true pray Judgment for those damages Above Acknowledged together with their Costs &
Charges afd. to them to be Adjudged &c
                 Therefore by Consent of the parties afd. it is Considered that the afd. John Gale and John Ponsonby
Recover Against the afd. Thomas Newbold his Damages afd. to the afd. Six pounds Six Shillings and Seven pence three farthings
207   Curt. Money by the Same Thomas in form afd. Acknowledged as also                                               Pounds of Tobacco
for their Costs and Charges afd. to the Same Gale & Ponsonby at their Request by the Court now here of the Assent of the parties afd.
Adjudged which Certain Damages in the whole Amount to Six pound Six Shillings and Seven pence three farthings Curt Money and

@    Command was given to the Sheriff of Somerset County that he Should Take Samuel Murray
SW    Samuel Murray    Late of Somerset County Planter if he Should be found in his Bailywick and him Should Safe keep
So that he might have his body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann
Town the third Tuesday of March Anno Dom. one thousand Seven hundred and Sixty One to Answer unto John Done
of A plea of trespass upon the Case &c. And the Same day is given to the afd. John here &c
      Att Which day here Came the afd. John Done by William Hayward his Attorney and the Sheriff to witt John
Dennis Gent. now here Returned that he had taken the afd. Samuel Murray whose body here at this day he had ready
to Answer the afd. John Done of the afd. plea as to him it was Commanded
           And hereupon the Said John Done Complained of the afd. Samuel Murray in the plea afd. in form following
Somerset fst Samuel Murray Late of Somerset County planter was Attached to Answer unto John Done of A plea of
trespass upon the Case and So forth       And Whereupon the Said John by William Hayward his Attorney Complains that
Whereas the Said Samuel the xxvi day of February Anno Dom. MDCCLXI at Somerset County afd. was Indebted
unto the Said John in the Sum of five pounds four Shillings and three pence Curt Money of Maryland for the Sundry
Articles and things in the Account hereto Annexed mentioned and So thereof Chargeable being the Said Samuel in
Consideration thereof afterwards to wit the Same day and Year afd. at the County afd. upon himself Assumed and to the Said
John then and there faithfully Promised that he the Said Samuel the Sum of Money afd. when he Should be thereto
Afterwards Required unto the Said John well and faithfully would pay and Content Nevertheless the Said
Samuel his Promise and Assumption afd. in form afd. made Little Regarding but minding and fraudulently Intending
the Said John in that part Craftily and Subtilly to deceive and defraud the Sum of Money afd. unto the Said John hath
not paid or him for the Same in Any Sort Contented Altho the Same to do the Same Samuel afterwards to wit the Same day
And Year afd. and often Since at the County afd. by the Said John was Required but the Same to him to pay hitherto
Altogether hath Refused and Still doth Refuse and unjustly Detain Whereupon the Said John Says he is worse
And hath damage to the Value of Twenty pounds Curt Money of Maryland and thereof he brings Suit & So forth
