   as it Stands Stated and that he nor no person for him



   Ever Recd. Any part parcell Security or Satisfaction
for the Same more than Credit Given to the Best of his Knowledge                                                    Before         Th Jones
Whereupon the Said Samuel Murray at the prayer of the afd. John Done is Adjudged to give Special Bail to the Action
afd. Thereupon a Certain Samuel Wilson of Somerset County Gent. present here in Court in his proper person undertook
for the Said Samuel Murray that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said
John Done Against the afd. Samuel Murray or that he the Said Samuel Murray Should be therein Convict that
then he the Said Samuel Murray Should pay and Satisfie unto the afd. John Done the Judgment of the Court thereupon
or Render his body in Execution of Such Judgment to the prison of the Sheriff of the County afd. in Satisfaction thereof
or that he the Said Samuel Wilson will do the Same for him &c.
      And hereupon the Said Samuel Murray by Samuel Wilson his Attorney Comes and defends the force and
Injury when &c. And Saith that he Cannot deny the Action afd. of the afd. John Done nor but that he did Assume upon
himself in Manner and form as the afd. John Done Above Against him hath Complained and as to the Damage of
the Same John by him by Occasion of the premisses in that part Sustained the Same Samuel Saith and Acknowledgeth
that the afd. John hath Sustained Damages by Occasion of the premisses beyond his Costs and Charges by him about his
Suit in that part Apposed to four pounds One Shilling and Nine pence Curt money and not more and because the afd. John
denys not this but the Same Allegation Grants to be true prays Judgment for those damages above Acknowledged together
with his Costs and Charges afd. to him to be Adjudged &c.
           Therefore by Consent of the parties afd. it is Considered that the afd. John Done Recover Against the
afd. Samuel Murray his Damages afd. to the afd. four pounds One Shilling and Nine pence Curt Money by the Same
195 3/4    Samuel in form afd. Acknowledged as also                                    Pounds of Tobacco for his Costs and Charges
afd. to the Same John at his Request by the Court now here Of the Assent of the parties afd. Adjudged which Certain
Damages in the Whole Amount to four pound One Shilling and Nine pence Curt Money and
                                         Pounds of Tobacco and the afd. Samuel in Mercy &c.

WH    Smith Horsey

@    Command was given to the Sheriff of Somerset County that he Should Take John Evans Late of
LD    John Evans    Somerset County planter Otherwise Called John Evans of Somerset County in the Province of Maryland planter
if he Should be found in his Bailywick and him Should Safe keep so that he might have his body before the
Justices of his Lordships County Court of Somerset to be held at Princes Ann Town in and for the County afd. the third
Tuesday of March Anno Dom. one thousand Seven hundred and Sixty One to Answer unto Smith Horsey of a plea
that he Render him forty Six Pounds one Shilling and Six pence Curt Money of Maryland which to him he Owes
and unjustly Detains and So forth and the Same day is given to the afd. Smith here &c
           Att which day here Came the afd. J Smith Horsey by William Hayward his Attorney and the Sheriff to witt
John Dennis Gent. now here Returned that he had taken the afd. John Evans whose body here at this day he had
Ready to Answer the afd. Smith Horsey of the afd. plea as to him it was Commanded
           Whereupon the Said Smith declared Against the afd. John Evans in the plea afd. in form following
Somerset fst John Evans Late of Somerset County planter Otherwise Called John Evans of Somerset County in Maryland
planter was Summoned to Answer unto Smith Horsey of A plea that he Render him the Sum of Forty Six pounds one
Shilling and Six pence Curt Money of Maryland which to him he Owes and unjustly detains and So forth
And Whereupon the Said Smith by William Hayward his Attorney Says that whereas the Said John the ix day of
Aprill Anno Dom. MDCCLVii at Somerset County afd. by his Certain Writing Obligatory which the Said Smith with the
Seal of the Said John Sealed here to the Court Shews whose date is the Same day and Year afd. Acknowledged himself to be
held and firmly Bound unto the Said Smith in the Sum of Forty Six pouns One Shilling and Six pence Current
Money of Maryland to be paid to the Said Smith when he the Said John Should be thereto afterwards Required Nevertheless
the Said John tho often thereto Required the Sum of Money afd. unto the Said Smith hath not paid but the Same to him
