March Court 1761 71 And the afd. Cornelius Ward & Cornelius Ward Junr by their Attorney afd. Come and defend the force and Injury when &c. And pray Leave thereof to Imparle here untill next Court to be held at Princes Ann Town in and for the County afd. the third Tuesday of November then next following and they have it and the Same day is given to the afd. Smith here also &c. Att which day here Came as well the afd. Plantiff as the afd. Defendants by their Attorneys afd. And hereupon the afd. Defendants pray further Leave thereof to Imparle here untill next Court to be held at Princes Ann Town in and for the County afd. the third Tuesday of March then next following and they have it And the Same day is given to the afd. Smith here also &c. Att which day here Came as well the afd. Plantiff as the afd. Defendants by their Attorneys afd. and hereupon the afd. Defendants as before defends the force and Injury when &c. And Say that they Cannot deny the Action afd. of the afd. Smith Horsey nor but that they Owe the Same Smith the afd. Seventy three Bushells of Indian Corn of the Value of Ten pounds Curt. Money in Manner and form as the afd. Smith above Against them hath declared Therefore it is Considered that the afd. Smith Horsey Recover Against the afd. Cornelius Ward & Cornelius Ward Junr his Debt afd. of the Value afd. and his Damages by Occasion of the detention of that Same debt to 223 1/2 Pounds of tobacco to the Same Smith of his Assent by the Court here Adjudged and the afd. Cornelius Ward & Cornelius Ward Junr in Mercy &c.
Town the third Tuesday of August Anno Dom. one thousand Seven hundred and Sixty to Answer unto John Gale and John Ponsonby of A plea of trespass upon the case &c. And the Same day is given to the afd. John Gale & John Ponsonby here &c. Att which day here Came the afd. Gale and Ponsonby by William Hayward his Attorney and the Sheriffe to witt John Dennis Gent. now here Returned that he had taken the afd. Thomas Newbold whose body here at this day he had Ready to Answer the afd. Gale and Ponsonby of the afd. plea as to him it was Commanded Whereupon the Said Thomas Newbold present here in Court in his proper person at the prayer of the afd. Gale and Ponsonby is Adjudged to give Special Bail to the Action afd. but for Want thereof the Said Thomas is Committed to the prison of the Sheriff of the County afd. there to Remain &c. And thereupon at the prayer of the parties afd. Day is to them now here given untill next Court to be held at Princes Ann Town the third Tuesday of November then next following in the State that now Saveing to by their Attorney afd. the parties afd. Att which day here Came as well the afd. Gale and Ponsonby ^ as the afd. Thomas Newbold in Custody as afd. And hereupon the Said Gale and Ponsonby Complained of the afd. Thomas Newbold in the plea afd. in form following Somerset fst Thomas Newbold Late of Somerset County Planter was Attached to Answer unto John Gale and John Ponsonby of A plea of trespass upon the Case and So forth And Whereupon the Said Gale and Ponsonby by William Hayward their Attorney Complain that whereas the Said Thomas the xxv day of February Anno Dom. MDCCIX at Somerset County afd. was Indebted unto the Said Gale and Ponsonby in the Sum of Eight pounds fourteen Shillings and Nine pence farthing Curt Money of Maryland for the Sundry Articles and things in the Account hereto Annexed mentioned and So thereof Indebted being the Said Thomas in Consideration thereof afterwards to wit the Same day and Year afd. at the County afd. upon himself Assumed and to the Said Gale and Ponsonby then and there faithfully Promised that he the Said Thomas the Sum of Money afd. when he Should be thereto afterwards Required unto the Said Gale and Ponsonby well and faithfully would pay and Content Nevertheless the Said Thomas his promise and Assumption afd. in form afd. made Little Regarding but minding and fraudulently Intending the Said Gale and Ponsonby in that part Craftily and Subtilly to deceive and defraud the Sum of Money afd. unto the Said Gale and Ponsonby hath not paid or them for the Same in Any Sort Contented (Altho the Same to do the Same Thmas afterwards to witt the Same day And Year afd. and often Since at the County afd. by the Said Gale and Ponsonby was Required but the Same to them to pay hitherto altogether hath Refused and Still doth Refuse and unjustly Detain Whereupon the Said Gale and Ponsonby Say they are worse and have Damage to the Value of thirty pounds Curt Money of Maryland and thereof they Bring Suit and So forth Pledges &c.
