March Court 1761 70 And the afd. Elias White by his Attorney afd. Comes and defends the force and Injury when &c. And prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of November then next following and he hath it and the Same day is given to the afd. Outerbridge here also &c Att which day here Came as well the afd. Outerbridge Horsey as the afd. Elias White by their Attorneys afd. and hereupon the Said Elias prays further Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of March then next following and he hath it and the Same day is given to the afd. Outerbridge here also &c. Att which day here Came as well the afd. Outerbridge Horsey as the afd. Elias White by their Attorneys afd. And hereupon the Said Elias as before defends the force and Injury when &c. And Saith that he Cannot deny the Action afd. of the afd. Outerbridge Horsey nor but that he Oweth the Same Outerbridge the afd. One hundred pounds Sterling in manner and form as the afd. Outerbridge Above Against him hath declared Therefore it is Considered that the afd. Outerbridge Horsey Recover Against the afd. Elias White his Debt afd. and his Damages by Occasion of 289 the detention of the Same debt to Pounds of Tobacco to the Same Outerbridge of his Assent by the Court here Adjudged And the afd. Elias in Mercy &c
Town in and for the County afd. the third Tuesday of June Anno Dom. one thousand Seven hundred and Sixty to Answer unto Smith Horsey of A plea that they Render unto him Seventy three Bushells of Merchantable Indian Corn of the Value of Ten pounds Curt. Money which from him they unjustly Detain &c. And the Same day is given tot he afd. Smith here &c. Att which day here Came the afd. Smith Horsey by William Hayward his Attorney and the Sheriff to witt John Dennis Gent. now here Returned that he had taken the afd. Cornelius Ward Senr & Cornelius Ward Junr whose bodys here at this Day he had ready to Answer the afd. Smith Horsey of the afd. plea as to him it was Commanded Whereupon the afd. Cornelius Ward Senr & Cornelius Ward Junr put in their place Samuel Wilson Gent. Attorney at Law Against the afd. Smith Horsey of the afd. plea And thereupon at the prayer of the parties afd. day is to them now here Given untill next Court to be in held at Princes Ann Town in and for the County afd. the third Tuesday of August then next following ^ State that now Saveing to the parties afd. Att which day here Came the parties afd. by their Attorneys afd. & and Cornelius Ward Jur. hereupon the Said Smith Horsey declared Against the afd. Cornelius Ward ^ in the plea afd. in form following Somerset fst Cornelius Ward Late of Somerset County planter and Cornelius Ward Jur Late of Somerset County planter Otherwise Called we were Summoned to Answer unto Smith Horsey of A plea that they Render unto him Seventy three Bushells of Merchantable Indian Corn of the Value of Ten pounds Curt. Money which from him they unjustly detain and So forth And Whereupon the Said Smith Horsey by William Hayward his Attorney Says that Whereas the Said Cornelius Ward and the Said Cornelius Ward Junr. the iii day of February Anno Dom. MDCCLIX at Somerset County afd. by their Certain Bill Obligatory which the Said Smith with the Seal of the Said Cornelius Ward and Cornelius Ward Jur Sealed here to the Court Shews whose date is the Same day and Year afd. Acknowledged themselves to Owe and be Indebted unto the Said Smith in the Quantity of Seventy three Bushells of Merchantable Indian Corn of the Value of Ten pounds Curt Money of Maryland to be paid to the Said Smith when they the Said Cornelius Ward and Cornelius Ward Junr Should be thereunto afterwards Required to the true payment whereof the Said Cornelius Ward and Cornelius Ward Junr. did Bind themselves firmly by the Same Bill Nevertheless the Said Cornelius Wad and Cornelius Ward Junr altho often thereto Required the afd. Seventy three Bushells of Merchantable Indian Corn of the Value of Ten pounds Curt. Money of Maryland unto the Said Smith they have not paid or him for the Same Any Sort Contented but the Same to him to pay hitherto altogether have Refused and Still do and Each of them doth Refuse and unjustly detain Whereupon the Said Smith Horsey Says he is Worse and hath Damage to the Value of Ten pounds Current money of Maryland and thereof he brings Suit and So forth Pledges &c J. Doe & R. Roe And |
