March Court 1761 68 being Elected tryed and Sworn upon their Oath Say that the afd. Gilbert Hoffington is not Guilty of the Premisses in the declaration mentioned in Manner and form as the afd. Gilbert above by pleading Alledged &c Therefore it is Considered that the afd. William Geddes take nothing by his Writt and declaration afd. but for his false Claim be thereof in Mercy and that the afd. Gilbert goe thereof Without day And also 736 afd. Gilbert Hoffington Recover Against the afd. William Geddes Pounds of tobacco for his Costs and Charges by him about his Defence in that part Sustained to the Same Gilbert by the Court here According to the form of the Statute in Such Case Lately made and provided Adjudged and that the afd. Gilbert have thereof Execution &c
Tuesday of November Anno Dom. one thousand Seven hundred and fifty Nine to Answer unto Samuel Kersey of A plea of trespass upon the Case &c. And the Same day is Given to the afd. Samuel here &c Att which day here Came the afd. Samuel Kersey by William Hayward his Attorney and the Sheriff to witt John Dennis Gent now here Returned that he had taken the afd. Esaw Boston whose body here at this day he had Ready to Answer the afd. Samuel Kersey of the afd. plea as to him it was Commanded Whereupon the Said Esaw Boston puts in his place Littleton Dennis Gent Attorney at Law Against the afd. Samuel Kersey of the afd. plea And thereupon at the prayer of the parties afd. day is to them now here Given untill next Court to be held at Princes Ann Town in and for the County afd. the third Tuesday of March then next following in the State that now Saveing to the parties afd. &c. Att which day here Came the afd. Parties by their Attorneys afd. And hereupon the Said Samuel Kersey Complained of the afd. Esaw Boston in the plea afd. in form following Somerset fst Esaw Boston Late of Somerset County Planter was Attached to Answer unto Samuel Kersey of A plea of trespass upon the Case and So forth And Whereupon the Said Samuel by William Hayward his Atty Complains that Whereas the Said Samuel is a Chast Liege And honest Liege Subject of the Said Lord the King that now is and as a Chast and honest ^ Subject of the Said Lord the King from the time of his Birth hitherto hath Behaved and Governed himself and of Good Name fame and Credit and of honest Life and Conversation and Condition with Good Grave Honrble and Honest men as well his Neighbours as other faithfull and Liege Subjects of the Said Lord the King that now is hitherto he hath been Accounted Known Called and Reputed and without Any Stain or Scandal of Whoredom fornication Inordinate Copulation Incontinancy or Any other fault hurtfull or Notorious Crime Unblemished and untouched by all the time afd. hath Carried Behaved and Governed himself and by Reason thereof the Said Samuel hath Deservedly Got himself the Great favour and Good will of Divers Honrble Persons and other Liege people of the Said Lord the King that now is Nevertheless the Said Esaw Well knowing the premisses afd. of his mear Malice prepence Endeavouring and Intending the Said Samuel not only in his Good Name Fame Repute Credit and Estimation afd. to hurt Detract Deprave Blemish and utterly Distroy but also the Said Samuel into Scandal Infamy and Extreem Discredit with the Honrble persons and Other faithfull Subjects afd. of the Said Lord the King that now is and him the Said Samuel the penalty Against Any White man his Committing Fornication and Inordinate Copulation with a Negro Woman to Incur on the tenth day of October Anno Dom. MDCCLIX in the presence and hearing of Very Many Liege Subjects of the Said Lord the King that now is at Somerset County afd. falsely and Malitiously Openly and Publickly did Speak Relate Publish and utter of the Same Samuel these false Ficticious defamatory and Scandalous English Words following to wit Samuel Kersey (the afd. Samuel Meaning and of him Speaking) is a Sorry Fellow for that he (the afd. Samuel again Meaning) knocked (meaning Fucked) his Negro Wench Pleasant the Negro Wench of the Said Esaw Named pleasant meaning by pretext of Speaking Relating and publishing of Wich Said false Scandalous and Defamatory English Words the Said Samuel much hurt and Injured is Whereupon the Said Samuel Says he is Worse and hath Damage to the Value of One hundred pounds Curt. Money of Maryland and thereof his Brings Suit and So forth with this that the Said Samuel doth Aver that the plain Sence and meaning of the Word knocked in the Decl mentioned is Fucked And is So in Language Generally Accepted and taken Pledges &c. J. Doe & R. Roe And the afd. Esaw Boston by his Attorney afd. Comes and Defends the force and Injury when &c. And prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town in and for the County afd. the third Tuesday of March then next following And he hath it And the Same day is given to the afd. Samuel here also &c Att which day here Came as well the afd. Samuel Kersey as the afd. Esaw Boston by their Attorneys afd. And hereupon the Said Esaw prays further Leave thereof to Imparle here untill next Court to be held at Princes Ann Town in and for the County afd. the third Tuesday of June then next following And he hath it And the Same day is given to the afd.
