March Court 1761 69 Att which day here Came as well the afd. Samuel Kersey as the afd. Esaw Boston by their Attorneys afd. And hereupon the Said Esaw prays further Leave thereof to Imparle here untill next Court to be held at Princes Ann Town in and for the County afd. the third Tuesday of August then next following and he hath it and the Same day is given to the afd. Samuel here also &c Att which day here Came as well the afd. Samuel Kersey as the afd. Esaw Boston by their Attorneys afd. Samuel here also &c. Att which day here Came as well the afd. Samuel Kersey as the afd. Esaw Boston by their Attorneys afd. And hereupon the Said Esaw as before defends the force and Injury when &c. And Saith that he is not Guilty of the premisses in the declaration mentioned in Manner and form as the afd. Samuel Above Against him hath Complained And of this he puts himself upon the Country And the Plf. in Like manner Thereupon Command is given to the Sheriff of Somerset County that he Should Cause to Come before his Lordships Justices the peace at the next Court to be held at Princes Ann Town in and for the County afd. the third Tuesday of March then next following twelve good free and Lawfull men of the County afd. Whereof Every one hath a free hold in the Said County) by Whom the truth of the premisses afd. may be the better known and who neither the afd. Samuel Kersey nor the afd. Esaw Boston touch by any Affinity to Recognize upon their Oath of and upon the premisses afd. because as well the afd. Samuel Kersey as the afd. Esaw Boston have put themselves upon that Jury and the Same day is given to the parties afd. here &c Att which day here Came as well the afd. Samuel Kersey as the afd. Esaw Boston by their Attorneys afd. And the Sheriff to witt John Dennis Gent Sheriff of the County afd. Returned the afd. Writ of Veniry facias and the Names of the Jurors in all things Served and Executed and the Jurors of that Jury thereof Impannelled being Called Some of them to witt George Irving, William Pollit, Marcy Beauchamp, George Day Scott, George Wails Michael Dorman, Zorobable King, Wm. McClemey, William Hath, James Polk, and William Fleming Came and were an Sworn upon that Jury and because the Residue of the Jurors of that Same Jury did not Appear therefore ^ other by Standers by the Sheriff of the County afd. hereunto Elected and at the Request of the afd. Samuel Kersey and by the Command of the afd. Justices is newly put on whose Name to the pannell within Written is filed According to the form of the Statute in Such Case made and provided which Same Juror so newly put on to witt John Anderson being Called Likewise Came who to Say the truth of the premisses afd. together with the Other Jurors afd. before Impannelled and Sworn being Elected tryed and Sworn upon their Oath Say that the afd. Esaw Boston is Guilty of the Premisses in the declaration mentioned in Manner and form as the afd. Samuel Kersey Above Against him hath Complained and Assessed the Damages of the Said Samuel by Occasion of the premisses afd. beyond his Costs and Charges by him about his Suit in that part Apposed to four pounds Ten Shillings and Six pence Curt Money of Maryland and for those Costs and Charges to One pound of Tobacco Therefore it is Considered that the afd. Samuel Kersey Recover Against the afd. Esaw Boston his Damages afd. by the Jurors afd. in form afd. 977 Pounds of Tobacco for his Costs and Charges afd. to the Same Samuel by the Court here of his Assent of Increase Adjudged which Damages in the Whole Amount to four pound Ten Shillings Curt Money & 978 Pounds of Tobacco And the afd. Esaw in Mercy &c.
Town the third Tuesday of March Anno Dom. one thousand Seven hundred and Sixty to Answer unto William Smith of A plea wherefore with force and Arms one Light Brindle Two year old Cow the proper Cow of the Said William Smith of the price of Five pounds Curt Money of Maryland at the County afd. he the Said William Baly with dogs did Sole and tare and himself with a Stake the Said Cow did Beat and Kill and other harms to him the Said William Smith then and there did to the Great Damage of the Said William Smith and Against our peace that now is &c And the Same day is given to the afd. Smith here &c Att which day here Came the afd. William Smith by William Allen his Attorney and the Sheriff |
