Specified of all which premisses the afd. William Geddes afterwards to wit the         day of         which was in the Year
of our Lord One thousand Seven hundred fifty and         at Somerset County unto the afd. James Wallace did Give
Notice by Means whereof the afd. James Wallace According to the use and Custom of Merchants from the whole time
afd. as before used and Approved became and was Chargeable to pay unto the afd. William Geddes the afd. forty pounds
Sterling in the afd. first Bill of Exchange mentioned with all the Lawfull Damages Costs and Interest by the afd. William
Geddes Suffered and Sustained for Want of due Acceptance of the Said first Bill or Exchange and by Occasion of the
non payment of the Contents thereof to the afd. William Geddes or Order and So thereof Chargeable being the Said James

Wallace in Consideration thereof Afterwards to wit the Same day and Year Last afd. at the County ^ afd. upon himself did
Assume and to the Said William Geddes then and there faithfully Promise that he the afd. James Wallace the
afd. forty Pounds Sterling with all Lawfull Costs Damages and Interest by the afd. William Geddes Suffered and
Sustained by Occasion of the Non Acceptance of the afd. first Bill of Exchange and non payment of the Contents thereof
when he Should be thereto Afterwards Required unto the afd. William Geddes well and faithfully would pay and
Content and the afd. William Geddes in fact Says that the Lawfull Costs Damages and Interest of him the afd. William
Geddes by the afd. Occasion of the non Acceptance and nonpayment of the Contents of the afd. first Bill of Exchange
do Amount unto the Sum of Forty Eight pounds Six Shillings and Six pence Sterling of Which the Same James Wallace
the Same day and year and place Last afd. had notice And the Said William Geddes in fact further Says that afterwards &
After the Publication of the Act of Assembly afd. to witt the         day of         in the Year of our Lord one
thousand Seven hundred fifty and         the afd. Sum of forty pounds Sterling in the afd. first Bill of Exchange Specified
together with all the Lawfull Costs Damages and Interest afd. which in the Whole Amount unto the Sum of Forty Eight
pounds Six Shillings and Six pence Sterling being in no Sort paid or Satisfied unto him the afd. William Geddes the afd.
Gilbert Hoffington did Convey and transport the afd. James Wallace out of this Province unto the Colony of
Virginia without his the afd. James haveing first Obtained Such pass as by the Act of Assembly afd. is directed
And that he the afd. Gilbert did not procure the Said James Wallace to Return within one Month thereafter
whereby the afd. James Wallace might have been Liable to Justice here (in this Province) by means whereof and
by force of the Act of Assembly afd. the afd. Gilbert became and is Liable to pay unto the afd. William Geddes the
afd. forty pounds Sterling in the afd. first Bill of Exchange mentioned And the afd. Forty Eight pounds Six Shillings &
Six pence Sterling the Lawfull Costs Damages and Interest which the afd. William Geddes Sustained as afd. by
Means of the Non Acceptance and non payment of the afd. first Bill of Exchange Nevertheless the Said
Gilbert Plotting Contriving and fraudulently Intending the Said William Geddes to Deceive and Defraud the
afd. Two Sums of Money which in the Whole Amount unto the Sum of Forty Eight pounds Six Shillings and Six
pence Sterling unto the afd. William Geddes hath not paid or him for the Same in Any Sort Contented (altho
the Same to do the Same Gilbert afterwards to wit the         day of         Anno Dom. MDCCL       and often Since at
the County afd. by the Said William Geddes was Required (but the Same to him to pay hitherto hath Refused and Still
doth Refuse Whereupon the Said William Geddes Says he is Worse and hath damage to the Value of Seventy pounds
Sterling money of Great Britain and thereof he brings Suit and So forth       Pledges &c J. Doe & R. Roe
   And the afd. Gilbert Hoffington by his Attorney afd. Comes and defends the force and Injury when &c. And prays Leave

thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of ^ March then next following
and he hath it and the Same day is given to the afd. William here also &c.
      Att which day here Came as well the afd. William Geddes as the afd. Gilbert Hoffington by their Attorneys afd. And hereupon
the Said Gilbert As before defends the force and Injury when &c. And prays further Saith that he is not Guilty of the Premisses
in the declaration mentioned in Manner and form as the afd. William above Against him hath Complained and of this he puts
himself upon the Country    And the Pltf. in Like manner
   Thereupon it is Commanded the Sheriff of Somerset County that he Should Cause to Come before his Lordships
Justices at the Next Court to be held at Princes Ann Town the third Tuesday of November then next following Twelve
