March Court 1761 67 Vessells or any Other persons from Transporting or Conveying away Any person or persons out of this Province without Passes made at a Session of Assembly begun and held at the City of Annapolis the Twenty Sixth day of April in the first year of the Reign or our Sovereign Lord George by the Grace of God of Great Britain France and Ireland King Defender of the faith &c. Annoq Domini One thousand Seven hundred and fifteen it was by the Kings most Excellent Majesty by and with the Advice and Consent of his Majesties Governour Councill and Assembly of this Province and the Authority of the Same Amongst Other things therein Contained and Enacted, Enacted that from and after the Publication of that Act Any person or persons whatsoever Intending to depart this province Shall first give notice of his her or their Intended Departure by Seting up his her or their Name or Names at the Secretarys Office of this Province and also at the Door of the Court house of the County where Such persons Reside at the time of Setting up Such Name as afd. the full Space of three Months that if in the time afd. no person Shall underwrite the Said Person or Persons So Sitting up his her or their Respective Name or Names as afd. it Shall be then Lawfull for the Governor keeper of the Great Seal or Secretary of this Province for the time being upon Certificate thereof from the Clerk of the Provincial Court and the Clerk of Such County where Such Name Shall be Set up as afd. to Sign a pass or passes to Any Such person or persons to Depart this Province for which the party Shall pay to the Secretary for Signing the Same the Sum of Two Shillings and Six pence and to the Clerk of the Provincial And County Court Twelve pence Each And if Any person or persons upon any Sudden or Imergent Occasion are Necessiated to depart this Province not haveing Set up his her or their Names at the Secretarys Office and County Court house Door as afd. then Such person or persons giving good and Sufficient Security to the Governour keeper of the Great Seal or Secretary to discharge and pay all Debts dues and Demands whatsoever due Owing or Demandable from the Said person to Any of the Inhabitants of this Province then the Said person or persons may have a pass Containing a Certficate of Such Security Given for which Shall be paid the Same fee as afd. and further by the Same Act afd. Amongst other things it is Enacted that any Master of Ships or Vessels or Other persons whatsoever that Shall Transport or Convey out of this province by Land or Water Any person being Indebted by Bill bond or Account or Otherwise to any Inhabitant thereof without Such pass or passes under the hand of the Governour Chancellor or Secretary as afd. Shall be Liable to Satisfie all Such Debts Engagements and Damages to the person or persons to whom Such Debts or Damages Respectively Shall be due within thie Province Except the Same be Otherwise Satisfied that the transporter or Conveyer away of Such persons or persons procure Such person or persons to Return Again within One Month after whereby he may be Liable to Justice here And Whereas after the Publication of the afd. Act of Assembly to wit on the Twenty fourth day of November which was in the Year of our Lord One thousand Seven hundred fifty and Six at Maryland to wit at Somerset County afd. A Certain James Wallace (the Said James then and there Negotiateing and Commerce using According to the use and Custom of Merchants from time whereof the Memory of Man is not Contrary to Such Case used and Approved did Make his Certain first Bill of Exchange in Writing bearing date the Same day and Year And the Same Bill of Exchange with his proper Name and hand then and there did Subscribe and that Bill unto a Certain Mr. Robert Wallace of Damhead Writer in Edinburch (then and Yet Negotiateing and Commerce using at Edinburgh to wit at Somerset County afd.) did direct and by the Same Bill of Exchange did Require the Same Robert Wallace at Sixty days Sight of that his first Bill or Exchange his Second and third of the Same tenor and date not paid to pay unto the afd. William Geddes (the Said William Geddes then and Yet Negotiateing and Commerce using to wit at Somerset County afd.) or Order the Sum of Forty Pounds Sterling for Value of him Received and place the Same to the Account of him the Said James Wallace and afterwards to wit the tenth day of May which was in the Year of our Lord One thousand Seven hundred fifty and Seven at Edinburgh to wit at Somerset County afd. the afd. first Bill of Exchange to the afd. Robert Wallace was Shewn And the Same Robert Wallace then and there was Required to Accept the Said first Bill of Exchange According to the use and Custom of Merchants from all the time afd. used and Approved & Make payment of the afd. forty pounds unto the afd. William Geddes According to the form and Effect of the afd. Bill (the afd. Robert Wallace before that time there haveing Sixty days Sight of the afd. first Bill of Exchange And the Said Second and third Bill of Exchange of the Same tenor and date or Either of them then or yet not being Accepted or paid) but the Same Robert Wallace the afd. first Bill of Exchange then and there to Accept did Refuse And the afd. forty pounds Sterling in the Said first Bill of Exchange Specified unto the afd. William Geddes According to the form and Effect of the Same first Bill of Exchange hath not paid by Reason whereof the Said first Bill of Exchange then & there According to the use and Custom of Merchants in that part in All the time afd. used and Approved in due form in Writing was protested for Want of Acceptance of the Same first Bill of Exchange and payment of the afd. forty pounds Sterling in the afd. first Bill of Exchange Specified |
