         March Court                 1761                   66
Shillings and Six pence Curt Money be Condemned in the hands of the afd. John Kellum and Joshua Whittington
Garnishees as afd. as of the Rights and Credits of the Said James Smith towards Satisfieing unto them the Said
Ephraim King and Thomas Wilson their Damages and all Costs and Charges Accrewing by means of the
Attachment afd.
                     Whereupon a Certain William Hayward of Somerset County Gent. present here in Court in his
proper person undertook for the Said Ephraim King and Thomas Wilson According to Act of Assembly that in Case
the Said James Smith do at Any time within a year and a day Appear and make all or Any part of the Said
King and Wilsons Claim Against him Appear to be Satisfied or Otherwise to have been undue before the
Laying of this Attachment that then the Said King and Wilson Shall make Restitution unto him the Said
James Smith of all or Such part as Shall be made Appear to be undue &c. or that he the Said William Hayward
will do the Same for him &c.
         Therefore it is Considered that the Severall Goods and Chattles so as afd. Attached and Appraised to the Sum
of five pounds Ten Shillings Curt Money may be Condemned as of the Goods and Chattles of the afd. James Smith
towards Satisfieing unto the Said King and Wilson their Damages and all Costs and Charges Accrewing by means of the
Attachment afd. and that the afd. King and Wilson have thereof Execution &c.
      Also it is Considered that the Sum of Twelve Shillings and Six pence Curt Money of Maryland So as afd. Confessed
by the Said John Kellum be Condemned in the hands of the Said John Kellum as of the Rights and Credits of the Said
James Smith towards Satisfieing unto the Said King and Wilson their Damages and all Costs and Charges Accrewing
by means of the Attachment afd. And that the Said King and Wison have thereof Execution &c.
      Also it is Considered that the Sum of Two pounds five Shillings Curt Money of Maryland so as afd. Confessed
by the afd. Joshua Whittington be Condemned in the hands of the Said Joshua as of the Rights and Credits of the
Said James Smith towards Satisfieing unto the Said King and Wilson their Damages and all Costs and Charges Accrewing
by means of the Attachment afd. And that the Said King and Wilson have thereof Execution &c.

@    Command was given to the Sheriff of Somerset County that he Should Take Gilbert
LD WA    Gilbert Hoffington    Hoffington Late of Somerset County planter if he Should be found in his Bailywick and him
Should Safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be
held at Princes Ann Town the third Tuesday of November Anno Dom. one thousand Seven hundred and fifty
Eight to Answer unto William Geddes of A plea of trespass upon the Case and So forth And the Same day is given to
the afd. William here &c.       Att which day here Came the afd. William Geddes by Wm. Hayward his Attorney and the
Sheriff to witt William Allen Gent. now here Returned that he had taken the afd. Gilbert Hoffington whose body here
at this day he had Ready to Answer the afd. Gilbert Hoffington of the afd. plea as to him it was Commanded
      Whereupon the Said Gilbert Hoffington at the prayer of the afd. William Geddes is Adjudged to give Special
Bail to the Action afd. Thereupon a Certain John Hoffington of Somerset County planter present here in Court in his
proper person undertook for the Said Gilbert Hoffington that if it Should happen that Judgment in the plea afd. Should
be Rendred for the Said William Geddes Against the afd. Gilbert Hoffington or that he the Said Gilbert Hoffington
Should be therein Convict that then he the Said Gilbert Should pay and Satisfie unto the afd. William the
Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the prison of the Sheriff
of the County afd. in Satisfaction thereof or that he the Said John Hoffington will do the Same for him &c.
   Whereupon the Said Gilbert Hoffington puts in his place Littleton Dennis Gent. Attorney at Law against
the afd. William Geddes of the afd. plea
      And thereupon at the prayer of the parties afd. day is to them now here given untill next Court to be held
at Princes Ann Town the third Tuesday of March then next following in the State that now Saveing to the
parties afd. &c.
                  Att which day here Came the parties afd. by their Attorneys afd. And hereupon the Said William
Geddes Complained of the afd. Gilbert Hoffington in the plea afd. in form following
Somerset fst Gilbert Hoffington Late of Somerset County planter was Attached to Answer unto William Geddes of
A plea of trespass upon the Case and So forth    And Whereupon the Said William by William Hayward his Attorney
Complains that whereas by an Act of Assembly of this Province Intituled an Acto Prohibiting all Masters of Ships or
