August Court 1760 45 Whereupon the said Purnall Newbold at ye. Prayer of ye. afd. Nicholas McCubbin is Adjudged to Give Special Bail to the action aforesaid Thereupon a certain Charles Cottingham of Somerset County Planter Present here in Court in his Proper person undertook for Purnall the said Nicholas McCubbin Should be Rendered for the said ^ Newbold or that he the said Purnall Should be therein Convict that then he the said Purnall should Pay and satisfie unto the aforesaid Nicholas the Judgment of the Court thereupon or Render his Body in Execution of such Judgment to the Prison of the Sherriffe of the County aforesaid in satisfa: ction thereof or that he the said Charles Cottingham will do the Same for him &c. Whereupon the said Purnall Newbold Puts in his place William Hayward gentleman attorney at Law against ye. aforesaid Nicholas McCubbin in the afd. plea And thereupon at the Prayer of ye. Parties afd. day is to them here now Given untill next Court to be held at Princes Ann Town the third Tuesday of August then next following in the State that now Saveing to ye. Parties aforesaid Att Which day here Came the Parties aforesaid by their Attys. afd. and hereupon the Said Nicholas McCubbin Delared against ye. afd. Purnall Newbold in the plea aforesaid in form following Somerset fst Purnall Newbold Late of Somerset County Marriner otherwise Called I Purnall Newbold of Sommerset County in the Province afd. Planter was Summoned to Answer unto Nicholas McCubbin of a plea that he Render him the full and Just Sum of fifty Six Pounds and Eight Pence Current money of Maryland which to him he owes and unjustly Detains and so forth And Whereupon the said Nicholas by Littleton Dennis his Atty Says that Whereas the Said Purnall the xx day of June Anno Dom. MDCCLX at Somerset County afd. by his Certain Writing Obligatory which he the said Nicholas with the seal of the said Purnall sealed here to the Court Shews Whose date is the Same day & Year aforesaid Acknowledged himself to be held And firmly Bound unto the Said Nicholas in the afd. Sum of Fifty Six Pounds & Eight Pence Current Money aforesaid to be paid to the Said Nicholas when he the aforesaid Purnall Should be thereto afterwards Required Nevertheless the said Purnall tho often Required the afd. Sum of MOney afd. to the said Nicholas hath not Rendered but the same to him to Render hitherto altogether hath denyed & still doth deny & unjustly Detain Whereupon the Said Nicholas Says he is worse and hath Damage to ye Value of fifty six Pounds & Eight Pence Current Money of Maryland & thereof he brings Suit &c. Pledges &c. John Doe & Richard Roe by his Attorney afd. Comes and and Injury When &c. And Saith that he Cannot deny the action afd. of ye. aforesd. Nicholas |
