August Court 1760 45 Says that whereas the said Thomas Newbold on the xxix day of December Anno Dom. MDCCLV at Somerset County afd. by his Certain Writing Obligatory Which the said Thomas Hayward with the Seal of the afd. Thomas Newbold Sealed here to the Court whose date is the same day and Year afd. Acknowledge himself to be held and firmly Bound unto the said Thomas Hayward in ye. pounds Sum of fifty four ^ paper money aforesaid to be paid to the said Thomas Hayward when he the aforesaid Thomas Newbold should be thereto afterwards required Nevertheless the said Thomas Newbold tho often thereto required ye. aforesaid Sum of Fifty four Pounds paper money aforesaid to ye aforesaid Thomas Hayward hath not rendered but the same to him to Render hitherto altogether hath denyed & Still doth deny & unjustly Detain Whereupon ye. said Thomas Hayward Says he is worse & hath Damage to the Value of Fifty four Pounds Current Money of Maryland & thereof he brings Suit &c Pledges &c John Doe & Richard Roe Newbold by his Atty afd. Comes and the force & Injury When &c. And saith that he Cannot deny the Action afd. of ye. afd. afd. Thomas Hayward nor but that the Writing Obligatory ^ is the Deed of him the said Thomas Newbold nor but that he owes the afd. Thomas Hayward the afd. sum of Fifty four Pounds Current Money of Maryland in Manner and form as the afd. Thomas Hayward above against him hath Declared Therefore it is Considered that the aforesaid Thomas Hayward Recover against the afd. Thomas Newbold his Debt afd. and his Damages by Occasion of the Detention of that same Debt to 281 Pounds of Tobacco to the same Thomas Hayward of his Assent by ye. Court here adjudged & ye. afd. Thomas Newbold in Mercy &c.
aforesaid Planter if he Should be found in his Bailywick & him should Safe keep so that he might have his Body before Justices of his Lordships County Court of Somerset to be held at Princes Ann Town ye. third Tuesday of June Anno Dom. one thousand seven hundred & sixty to Answer unto Nicholas McCubbin of a plea that he render him ye. full & Just sum of fifty six pounds & Eight pence Current money of Maryland which to him he owes & unjustly Detains and so forth And ye. same day is given to ye. afd. Nicholas here & so forth Att Which day here Came the afd. Nicholas McCubbin by Littleton Dennis his Atty. & ye sherriffe to wit John Dennis gentleman now here returned that he had taken ye. afd. Purnall Newbold whose Body here at this day he had Ready to answer ye. afd. Nicholas of ye. afd. plea as to him it was Commanded Whereupon |
