WH    Thomas Hayward Senr.    Command was Given to the Sherriffe of Somerset County that

 vs    he Should take Thomas Newbold Late of Somerset County
LD    Thomas Newbold    Planter otherwise Called Thomas Newbold if he Should be
found in his Bailywick & him Should Safe keep so that he might have his
Body before the Justices of his Lordships County Court of Somerset to be
held at Princes Ann Town &c. third Tuesday of June Anno Dom. one thous:
and Seven hundred and Sixty to Answer unto Thomas Hayward of a plea that
he render him fifty four Pounds Current money of Maryland which to him he
Owes and unjustly Detains &c.
And ye. Same day is given to ye. afd. Thomas here &c.
Att Which day here Came ye. afd. Thomas Hayward by William Hayward
his Attorney and ye. Sherriffe to wit John Dennis gentleman now here returned
that he had taken the afd. Thomas Newbold whose Body here at this day
he had ready to answer the afd. Thomas Hayward of ye. afd. Plea as to him it was Commanded
Whereupon the said Thomas Newbold at ye. Prayer of ye. afd. Thomas Hayward
is Adjudged to give Special Bail to the action afd. Thereupon A Certain Purnall
Newbold of Somerset County Planter Present here in Court in his Proper
Person undertook for the said Thomas Newbold that if it Should happen that
Judgment in the plea aforesaid Should be Rendered for the said Thomas Hayward
against the aforesaid Thomas Newbold or that he the said Thomas Newbold Should
be therein Convict that then he the said Thomas Newbold Should Pay and
Satisfie unto the afd. Thomas Hayward the Judgment of the Court thereupon
of render his Body in Execution of Such Judgment to the Prison of the Sheriff
of ye. County afd. in Satisfaction thereof or that he the said Purnall Newbold
will do the Same for him &c.
Whereupon the said Thomas Newbold puts in his place Littleton Dennis Gentleman
and thereupon at the Prayer of ye. Parties afd. day is to them here now given
untill next Court to be held at Princes Ann Town ye. third Tuesday of August
then next following in ye. State that now Saveing to ye. Parties aforesaid
Att Which day here Came the Parties aforesaid by their Attys. and hereupon
the said Thomas Hayward Declared against ye. afd. Thomas Newbold in ye.
plea aforesaid in form following
Somerset fst Thomas Newbold Late of Somerset County planter Present
Called Thomas Newbold of Somerset County Platner was summoned to Ans:
:wer unto Thomas Hayward of a plea that he render unto him ye. Sum of
fifty four Pounds Paper money Maryland Currency which to him he owes and
unjustly Detains & so forth
And Whereupon the said Thomas Hayward by William Hayward his Atty
