August Court 1760 44 Arms he the aforesaid John in and upon the aforesaid Young Bailey and Assault Did make & him the afd. Young Bailey then & there did Beat Wound & Evilly Treat so that of his life it was greatly Dispaired & other harms him the said Young Bailey then and there did to great Damage of ye. said Young Bailey then & there did to ye great Damage of ye said Young Bailey & against ye Peace of ye Right Honrble ye Lord Propry that now is his good Rule and government &a. And Whereupon the said Young Bailey by William Hayward his Attorney Complains that the said John Covington ye. first day of May Anno Domi. MDCCLIX at Somerset County Afd with force and Arms in and upon ye Said Young an Assault did make and him ye Said Young Bailey then & there did beat wound and Evilly Treat so that of his Life it was Dispaired and other Harms to him ye said Young Bailey then & there did to ye. great Damage of ye said Young Bailey and Against ye Peace of ye. Right Honrble the Lord Propry that now is his good Rule & government &a. To the Damage of ye said Young Bailey Twenty Pounds Current money of Maryland and thereof he brings Suit & so forth Pledges &a. John Doe & Richard Roe And the aforesaid John Covington by Samuel Wilson his Attorney Comes and Defends the force and Injury when &a. And prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town ye third Tuesday of August then next follg. and he hath it & ye same day is given to ye Afd Young Bailey here Also & Att Which day here Came as well ye afd. Young Bailey as ye afd. John by their Attys afd and hereupon ye said John as before defendends ye force and Injury when & And Saith that he Cannot deny the Action afd of ye afd Young Bailey nor but that he is guilty of the Premisses in the Declaration Mentioned in manner and form as the afd Young Bailey above against him hath Complained and as to the Damage of ye. same Young Bailey by him by Occasion of ye Premisses in that part Sustained the same John Saith and Acknowledgeth that the afd Young Bailey hath Sustained Damages by Occasion of ye Premisses beyond his Costs and Charges by him About his Suit in that part apposed to Twelve Pounds ten shillings Current Money and not more & because ye afd Young Bailey denys not this but the Same Allegation grants to be true prays judgment for those Damages above acknowledged together with his Costs and Charges afd to him to be Adjudged Therefore by Consent of ye Parties Afd. it is Considered that the afd. Young Bailey Recover against ye Afd. John Covington his Damages afd to ye Afd. Twelve Pounds ten shillings Current Money by the Same John in form afd 202 Acknowledged as also Pounds of Tobacco for his Costs and Charges afd. to ye. Same Young Bailey at his request by ye Court now here of ye Assent of ye Parties afd. adjudged which Certain Damages in ye whole Amount to Twelve Pounds ten shillings Currt Money & Pounds of Tobacco & ye Afd John in Mercy &a. |
