August Court 1760 41 Guilty and for Tryall thereof puts himself upon ye. County and William Hayward Gent. his Lordships Atty who for his Said Lordship in this part Prosecuteth in Like manner Thereupon ye. said James Riggen is ordered to Recognize with one Security in ten Pounds Current money for his the said James Riggen appearance at ye. next Court to be held at Princes Ann Town in and for ye. County aforesaid ye third Tuesday of August then next following to answer unto his Said Lordship of and Concerning The Indictment aforesaid and to Stand & abide ye. Judgment of ye. Court Thereupon & in ye. meantime be of ye. good behaviour Thereupon the Said James Riggen with William Allen of Somerset County Gent his Security both present here in Court in their Proper person Acknowledged themselves Indebted unto his said Lordship in ye. Sum of ten pounds Current money of Maryland of their Bodies Goods and Chattles Lands & Tenements Joyntly and severally to ye. use of his said Lordship his heirs & successors to be made and Levied if it happen that ye. said James Riggen do not make his Personall Appearance before ye. Justices of his Lordships County Court of Somerset to be held at Princes Ann Town ye. third Tuesday of August then next following and do not answer unto his Said Lordship of and Concerning ye. Indictment aforesaid & do not stand and abide ye. Judgment of ye. Court thereupon and do not depart ye. same Court without Leave and in ye. meantime if he ye. James Riggen be not of ye. good Behaviour &c. Thereupon it was Commanded ye. Sherriffe of Somerset County that he should Cause to Come before his Lordships Justices at ye. next Court to be held at Princes Ann Town ye. third Tuesday of August then next following twelve Good and Lawfull men of his Bailywick by whom the truth of ye. Premisses may be ye. better known and who are of no Affinity to ye said James Riggen to Recognize upon their Oath if the said James Riggen be guilty of ye Premisses afd. or not because as well ye. afd. William Hayward his Lordships Atty who for his said Lordship in this Part Prosecuteth as ye. afd. James Riggen have put themselves upon that Jury Att which said third Tuesday of August Came as well ye. afd. William Hayward gentleman his Lordships Atty. who for his said Lordship in this part Prosecuteth in ye. afd. James Riggen in his Proper person According to his Recognizance by him & his Sery in that part before acknowledged &c. And ye. Sherriffe to wit John Dennis gentleman Sherriffe of ye. County afd. Returned ye afd. Writt of Veniry facias and ye names of ye Jurors in all things Served and Executed and the Jurors of that Jury thereof Impanneled being Called to witt, William Skirvin, Spencer Harris, Marcey Beachamp, William Warwick, David Wilson, Isaac Coulbourn, Joseph Scroggin, Jessey Dashiell, George Pollit, Jno. Hoffington, Jonathan Pollit and Samuel Kersey being Called Came to say the truth of their Premisses being Elected Tryed & Sworn upon their Oath Say that ye. said James Riggen is guilty of ye. Premisses afd. in ye. Indictment afd. above upon him Imposed Whereupon all and singular the Premisses being Seen and by ye Court here fully understood it is Considered by ye. Court here that ye afd. James Riggen for ye. Premisses & offence afd. in ye. Indictment afd. above Specified be taken &c Which said James Riggen present here in Court as afd. is fined for ye. Premisses & offence afd. the sum of five Shillings Current money which he paid here in Court to ye. sherriffe of ye. County afd. for ye. use of his said Lordship &c. |
