August Court 1760 41 Somerset to be held at Princes Ann Town ye. third Tuesday of August then next follg. And do not Answer unto his Said Lordship of and Concerning ye. Indictment afd. and do Not stand & abide ye Judgment of ye. Court thereon and do not Depart the Same Court Without Leave and in ye meantime if he ye. said John Donohoe be of ye. good behaviour Thereupon it was Commaned ye. sherriffe of Somerset County that he Should Cause to Come before his Said Lordships Justices of ye. next Court to be held at Princes Ann Town the third Tuesday of Augut then next following Twelve good and Lawfull men of his Bailywick by whom ye. truth of ye. Premisses may be ye. better known and who are of no Affinity to ye. said John Donohoe to Recognize upon their Oath if ye. said John Donohoe be guilty of ye. Premisses afd. or not because as well ye. afd. William Hayward gent his Lordships Attorney who for his said Lordship in this part Prosecuteth as ye. aforesaid John Donohoe have put themselves upon that Jury Att which said third Tuesday of August Came as well ye. afd. William Hayward gent. his Lorships Atty. who for his said Lordship in this part Prosecuteth in ye. afd. John Donohoe in his Proper person according to his Recognizance by him & his Sery in that part before acknowledged &c And the Sheriff to witt John Dennis Gent. Sheriff of the County afd. Returned the afd. Writt of Veniry facias And the names of the Jurors in all things Served and Executed and the Jurors of that Jury thereof Impannelled being called to witt, William Skirven, Spencer Harris, Massey Beachamp, Wm. Warwick, David Wilson, Isaac Coulbourn, Joseph Scroggin, Jesse Dashiell, Isaac Atkinson, Michll. Dorman, Charles Leatherbury and Stacey Miles, being Called Came to Say the truth of these Premisses being Elected Tryed & sworn upon their Oath say that the said John Donohoe is not guilty of ye. Premisses afd. in ye. Indictment afd. above specified in manner & form as ye. afd. John Donohoe for himself above by his plea hath alledged upon which it is Considered by the Court here that ye. aforesaid John Donohoe of ye. Premisses aforesaid in ye. Indictment afd. above specified be Discharged & goe thereof without day &c
in and upon a Certain Ambros Fitzwaters in ye. peace of God and ye. said Lord Propry then & there being and Assault did make and him ye said Ambros then & there did beat wound & Evilly Treat so that of his Life it was much Dispaired & other Harms to ye said Ambros then & there did to ye. great Damage of ye. said Ambros and against ye. peace of his said Lordship that now is his good Rule & government & so forth Thereupon it was Commanded the sherriffe of Somerset County that he Should said take ye ^ James Riggen if he Should be found in his Bailywick & him Should Safe keep so that he might have his Body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town ye third Tuesday of June Anno Dom. One thousand seven hundred & sixty to answer unto his Lordship of and Concerning ye. Indictment afd. Att which said third Tuesday of June & Year afd. Came ye. afd. James Riggen in his Proper person & had & hearing of ye. Indictment afd. Saith that he is not thereof guilty |
