August Court 1760 40 Thereof Guilty And of this he puts himself upon the Country & William Hayward gentleman who for his Said Lordship in that part followeth Likewise Therefore Immediately Let Come Thereof the Jury before his Lordships Justices thereby Whom &c. Who neither &c. And the Jurors of that Jury by John Dennis Sherriffe of ye. County Aforesaid to that Impannelled to wit, William Skivin, Spencer Harris, Marcey Beachamp, William Warwick, David Wilson, Isaac Coulbourn, Joseph Scroggin, Christopher Piper, Jonathan came Pollit, Stacey Miles, John Hoffington & John Pollit being Called ^ to Say the truth of The Premisses being Elected Tryed & Sworn upon their Oath Say that the said David Jenckins is not guilty of ye. Premisses afd. in ye. Indictment afd. above specified in Manner and form as the afd. David Jenckins as above by his plea hath alledged Upon Which it is Considered by ye. Court here that the afd. David of ye. Premisses Aforesaid in ye. Indictment aforesaid Above specified be Discharged and go without Day &c.
in and upon A Certain Ambros Fitzwaters in ye. peace of God & ye. said Lord Propry then & there being an Assault did make & him ye. said Ambros then & there did beat wound & evilly Treat so that of his Life it was much Dispaired and other harms to the said Ambros then and there did to ye. great Damage of ye. said Ambros and against ye peace of his Said Lordship that now is his good rule & government &c Thereupon it was Commanded ye. Sherriffe of Somerset County that he should take ye. said John Donohoe if he should be found in his Bailywick & him should safe keep so that he Might have his Body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town ye. third Tuesday of June Anno Dom. one thousand seven hundred & sixty to answer unto his Lordship of & Concerning ye. Indictment aforesaid Att Which said Third Tuesday of June & Year afd. Came ye afd. John Donohoe in his proper per: :son and had a hearing of ye Indictment aforesaid Saith that he is not thereof guilty and for tryall Thereof puts himself upon ye. Country and William Hayward gentleman his Lordships Attorney who for his said Lordship in this part Prosecuteth in Like Manner Thereupon the Said John Donohoe is Ordered to Recognize with one Sery in Ten pounds Current money for his ye. said John Donohoes Appearance at the next Court to be held at Princes Ann Town the third Tuesday of June then next following to answer unto his said Lordship of and Concerning ye. Indictment afd. & to stand and abide ye. Judgment of ye. Court thereupon & in ye. meantime to be of ye. good behaviour Thereupon ye. said John Donohoe with William Allen gentleman his Sery both Present here in Court in their Proper persons Acknowledged themselves indebted unto his Said Lordship in ye. Sum of ten pounds Current money of Maryland of their Bodies Goods & Chattles Lands & Tenements Joyntly & Severally to ye use of his Said Lordship his heirs And Successors to be made & Levied if it happen that the said John Donohoe do not Make his Personall appearance before ye.
