August Court 1760 40 Stephen A Writt Issued Against him and ye. Samuel at ye Suit of ye said Mitchell was returned not to be found on the xiv day of September Anno Dom. MDCCLIX at the Coty by their Certain Writing Obligatory which the Said Mitchell Sealed with the Seal of ye. Said Samuel and Stephen here to the Court Shews whose date is the day and Year Aforesaid Acknowledged themselves to be held and firmly Bound to ye. said Mitchell in the Sum of fifteen pounds Current money of Virginia of ye. Value of Twenty Pounds Current money of Maryland to be paid to ye. said Mitchell when afterwards they Should be thereto required Yet the aforesaid Samuel nor Stephen altho often thereto severally Required ye. Said Sum of Virginia Money of ye. value aforesaid or the value thereof as hath aforesaid nor ethier of them ^ but the same to him to pay hitherto hath Denyed & Still doth deny ye. Same from him unjustly Detains to ye. Damage of ye. said Mitchell Twenty Pounds Current money of Maryland & thereof he brings Suit &c. Pledges &c. John Doe & Richard Roe by his Attorney afd. Comes & And saith that he Cannot deny ye. Action afd. of the afd. Mitchell nor but that the Writing Obligatory aforesaid is ye. Deed of him ye. said Samuel nor but that he owes ye. afd. Mitchell Bannister the afd. sum of fifteen pounds Virginia Money of ye Value of Twenty Pounds Current Money of Maryland in manner and form as ye. aforesaid Mitchell above against him hath Declared Therefore it is Considered that the aforesaid Mitchell Bannister Recover Against the aforesaid Samuell Horsey his Debt aforesaid & 199 His Damages by Occasion of ye. Detention of that same Debt to Pounds of Tobacco to ye. same Mitchell of his Assent by ye. Court here adjudged and ye. aforesaid Samuell Horsey in Mercy &c.
in ye County aforesaid in and upon A Certain John Mitchell in ye peace of God and ye said Lord Propry then & there being an Assault did make and him ye. said John then & there did beat wound and Evilly Treat so that of his Life it was much Dispaired and other harms to ye. said John then and there did to the great Damage of ye said John and against ye peace of his Said Lordship that now is his good rule & government &c. Thereupon it was Commanded ye. Sherriffe of Somerset County that he Should take the said David Jenckins if he Should be found in his Bailywick & him Should Safe keep so that he might have his Body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town ye. third Tuesday of August Anno Dom. one thousand seven said hundred & sixty to answer unto his ^ Lordship of & Concerning ye. Indictment afd. Att which said third Tuesday of August & Year afd. Came ye afd. David Jenckins by Littleton Dennis Gent. his Atty & had a hearing of ye Indictment afd. And Saith that his is not guilty |
