August Court 1760 38 The Right Honrble the Lord Propry that now is for ye. Body of Somerset County upon their Oath present that Nathaniel Whitaker Late of Coventry Parish in ye. County aforesaid Clerk on ye. twenty Ninth day of December in ye. Year of our Lord one thousand Seven hundred fifty & Nine with force and Arms at ye. Parish aforesaid in ye. County aforesaid with a Certain Charged Gun which he the said Nathaniel in boath his hands then & there had and held in and upon a Certain Thomas Seon in the peace of God and ye. said Lord Propry then & there being an Assault did make with an intent him ye. said Thomas then & there Feloniously, willfully, and of his Mallice aforethought, to kill and Murder and other Wrongs to the said Thomas then & there did to the great Damage of ye. said Thomas and against the peace of his Said Lordship that now is his Good Rule & government &c Thereupon it was Commanded ye. Sherriffe of Somerset County that Immediately he Should take The said Nathaniel Whitaker if &c. to Answer &c. And afterwards in ye. Same Court before the Justices thereof Came the afd. Nathaniel Whitaker in his proper person and had a hearing of ye. Indictment afd. Saith that his is not thereof Guilty and for tryall thereof puts himself upon ye. Country and William Hayward Gentleman his Lordships Attorney who for his said Lordship in this Prosecuteth in Like manner Thereupon the said Nathaniel Whitaker is ordered to Recognize with one Sery in Twenty Pounds Current Money for his ye said Nathaniel Whitaker appearance at ye next Court to be held at Princes Ann Town in and for the County aforesaid the third Tuesday of June then next following to answer unto his said Lordship of and Concerning ye. Indictment afd. and to Stand & abide the Judgment of ye. Court thereupon & in ye. meantime to be of ye. good Behaviour Thereupon the said Nathaniel Whitaker with Littleton of Somerset County Gentleman his Sery both present here in Court in their proper persons Acknowledged themselves indebted unto his said Lordship in the Sum of Twenty Pounds Current money of Maryland of their Bodies Goods & Chattles Lands & Tenements Joyntly & Severally to ye. use of his said Lordship his heirs & Successors to be made & Levied if it happen that ye. said Nathaniel Whitaker do not make his Personall appearance before ye. Justices of his Lordships County Court of Somerset to be held at Princes Ann Town ye. third Tuesday of June then next following and do not answer unto his said Lordship of and Concerning the Indictment aforesaid & do not Stand and abide the Judgmt. of ye. Court therein and do not Depart the same Court without Leave and in ye. meantime if he the said Nathaniel Whitaker be of ye. Good Behaviour &c. Thereupon it is Commanded ye. sherriffe of Somerset County that he should Cause to Come before his Lordships Justices at ye. next Court to be held at Princes Ann Town the third Tuesday of June then next following twelve Good and Lawfull men of his Bailywick by whom the truth of ye. premisses may be better known and who are of no affinity to ye. said Nath: :aniel Whitaker to recognize upon their Oath if the said Nathaniel Whitaker be guilty of the Premisses afd. or not because as well the aforesaid William Hayward gentleman his Lordships Attorney who for his said Lordship in this part prosecuteth as ye. aforesaid Nathaniel Whitaker have put themselves upon ye. Jury Att which said third Tuesday Came the afd. William Hayward gentleman his Lordships Attorney who for his Said Lordship in this part Prosecuteth & the afd. Nathaniel Whitaker altho Solemnly Called Came not According to ye. tenor of his Recognizance in that before Acknowledged thereupon his Recognizance afd. is by ye Court here respited untill the next Court to be held at Princes Ann Town in and for the County aforesaid the third Tuesday of August then next following to Answer &c. And ye. sherriffe to wit John Dennis gentleman of ye. County aforesaid did not send thereof the Writt &c. Therefore as before it is Commanded ye. sherriffe of Somerset County that he Cause to Come |
