August Court 1760 38 Come before his Lordships Justices at ye. next Court to be held at Princes Ann Town the third Tuesday of August Twelve &c. to Recognize in form afd. &c. because as well &c. Att Which Said third Tuesday of August Came as well the afd. William Hayward Gentlemn. his Lordships Atty who for his said Lordship in this part Prosecuteth as ye. aforesaid Nathaniel Whitaker in his proper person According to his Recognizance by him and his Sery in that part before acknowledged &c. Whereupon his said Lordships Writt of Certiorari being offered to his Lordships Justices the Tenor whereof followeth (in these words) Maryland fst Frederick Absolute Lord and Propry of ye. Provinces of Maryland & Avalon Lord Baron of Baltimore &c. To the Justices and Clerk of Somerset County greeting we being willing for A Certain Causes that the Record and Proceedings of a Certain presentment or Indictment before you Depending Against Nathaniel Whitaker of Somerset County Clerk should be Certified by you to the Justices of our Provincial Court at the City of Annapolis we Command ye that the record & proceedings with everything thereunto Relating as full and intire & in as Ample manner & form as they remain before ye by whtsoever name and Addition the Said Nathaniel Whitaker be reputed ye have before the Justices of our Provincial to be held at Annapolis the second Tuesday of September next under your hands & Seals You Send together with this writ that our Same Justices May further do therein that which of Right they See ought to be done Witness John Brice Esqr. Chief Justice of our said Provincial Court the 12th. day of April in ye 9th Year of our Dominion &c. Annoque Domini 1760 (E Dorsey) Reverdy Ghiselin Cl. Isd 12th. April 1760 Allowed pr Robt. Jenckins Henry Maryland fst I hereby Certifie whom it may Concern that Nathaniel Whitaker upon the Eighth day of August 1760 with John Dennis Junr. & Littleton Dennis his Security Came before me one of his Lordships Justices of ye. Provincial Court and did recognize According to ye. form of the statute in Such Case made & provided in ye. Sum of Twenty Pounds Sterling each with Condition at the Return of the within Writt to Appear in ye. provincial Court & plead to the Indictment or Presentment within mentioned & at his own Costs to procure the Issue that shall be joined upon ye. said Indictment or Presentment or any plea relating thereto to be tried at ye next provincial Court or at ye setting after the next Provincial Court of ye. said Provincial Court shall not Appoint any time for ye tryall thereof Robt Jenckins Henry The Record and Proceedings whereof in the Writt afd. are mentioned with all that Happened Appear by the Record to this Writt Annexed
Anno Dom. one thousand Seven hundred & Sixty to answer unto Thomas Muir of a plea of Trespass upon ye. Case &c. And ye. same day is given to ye. afd. Thomas here and so forth And hereupon the said Thomas Muir Complained against the afd. John Waller in ye. plea afd. in form following Somerset fst John Waller Late of Somerset County Planter was attached to answer unto Thomas Muir of a plea of Trespass upon ye. Case &c.
