        August Court                 1760                 37
Coventry Parish in ye. County aforesaid Clirk on ye. twenty Ninth day of December in
the Year of our Lord one thousand seven hundred fifty & Nine with force and Arms at ye.
Parish aforesaid in ye. County aforesaid with a Certain Charged gun which he ye. said
Nathaniel in Both his Hands then & there had & held in and upon a Certain John
Sadler in ye. peace of God & ye. Said Lord propry then & there being an Assault did make
With an Intent him ye. said John Sadler then & there feloniously willfully and of his
Malice aforethought to kill & Murder & other Wrongs to ye. said John then & there did to ye.
great Damage of ye. Said John and against the peace of his Said Lordship that now is his
Good Rule & government &c.
Thereupon it was Commanded the sherriffe of Somerset County that Immediately he Should
take the said Nathaniel Whitaker if &c. to Answer &c.
And afterwards in ye. Same Court before Justices thereof Came the afd. Nathaniel Whitaker in
his proper person & had a hearing of ye. Indictment aforesaid Saith that he is not thereof guilty &
for tryall thereof puts himself upon ye. Country and William Hayward Gentleman his Lordships
Attorney who for his said Lordship in this part prosecuteth in like manner
   Thereupon the said Nathaniel Whitaker is ordered to Recognize with one Sery in Twenty
Pound Current Money for his the said Nathaniel Whitaker appearance at ye. next Court
to be held at Princes Ann Town in and for ye. County aforesaid the third Tuesday of June then
Next following to Answer unto his said Lordship of an Concerning ye. Indictment afd.
and to Stand & Abide the Judgment of ye. Court thereupon & in ye. meantime to be of ye. good
Behaviour
           Thereupon the said Nathaniel Whitaker with Littleton Dennis of Somerset County Gent.
his Serys both present here in Court in their proper persons Acknowledged themselves indebted
unto his said Lordship in ye. Sum of twenty Pounds Current money of Maryland of their
Bodies Goods and Chattles Lands & Tenements Joyntly & severally to ye. use of his said Lordship
his heirs & successors to be made & Levied if it happen that ye. said Nathaniel Whitaker do not
make his personall Appearance before the Justices of his Lordships County Court of Somerset to be
held at Princes Ann Town the third Tuesday of June then next following and do not answer unto his
Said Lordship of And Concerning he Indictment afd. and do not Stand & Abide the Judgment of the Court
thereon & do not Depart the same Court without Leave and in ye. meantime if he the said

Nathaniel Whitaker be ^ of ye. good Behaviour &c.
   Thereupon it was Commanded ye. Sherriffe of Somerset County that he should Cause to Come
                                                                         in and for the Coty of Somerset afd
before his Lordships Justices at ye. next Court to be held at Princes Ann Town ^ the third
Tuesday of June then next following Twelve Good and Lawfull men of his Bailywick by
Whom the truth of ye. Premisses may be better known and whoe are of no Affinity to ye said
Nathaniel Whitaker to Recognize upon their Oath if ye. said Nathaniel Whitaker be Guilty of
ye. Premisses afd. or not because as well ye. afd. William Hayward gentleman his Lordships
Attorney who for his Said Lordship in this part Prosecuteth as ye. afd. Nathaniel Whitaker
have put themselves upon that Jury    Att which said third Tuesday of June Came ye. aforesaid
William Hayward gentleman his Lordships Attorney who for his said Lordship in this
Part Prosecuteth & ye. afd. Nathaniel Whitaker altho Solemnly Called Came not according
                                                                     the Said Natl Whitaker
to ye. tenor of his Recognizance in that Part before acknowledged thereupon ^ his Recoge. afd. is
                                                                                             Town
by ye. Court here respited untill ye. next Court to be held at Princes Ann ^ in and for ye. County
afd. the third Tuesday of August then next following to answer &c.

And ye. sherriffe to wit John Dennis Gent. ^ of ye. County afd. did not Send thereof the writ &c.
Therefore as before it is Commanded ye. sherriffe of Somerset County that he Cause to Come
before his Lordships Justices at ye Next Court to be held at Princes Ann Town the third Tuesday
of August Twelve &c. to Recognize in form afd. &c. because as well &c.
