June Court 1760 24 Whereupon ye. said John Covington puts in his place Samuel Wilson Gent. attorney at Law against the afd. Henry Ward in ye. afd. plea And thereupon at ye. Prayer of ye. Parties afd. day is to them here now given untill next Court to be held at Princes Ann Town ye. third Tuesday of June then next following in ye. State that now Saving to ye. Parties afd. &c. Att which day here Came ye. Parties afd. by their Attys. afd. and hereupon ye. Said Henry Ward Complained agt. ye. afd. John Covington in ye. plea afd. in form following Somerset to wit John Covington Late of Somerset County Gentleman was attached to Answer unto Henry Ward of a plea of trespass upon ye. Case &c. And Whereupon ye. said Henry by Wm. Hayward his attorney Complains that Whereas ye. said John on ye. xth. day of June Anno Dom. MDCCLIX at ye. County afd. was Indebted unto ye. said Henry in ye. Sum of nine pounds nine shillings and seven pence Current money of Maryland for ye. Articles in ye. Account hereto Annexed mentioned and So thereof Indebted being ye. said John in Consideration thereof afterwards to wit, ye. Same day & Year afd. at the County afd. upon himself Assumed and to ye. said Henry then and there faithfully Promised that he ye. afd. John ye. Sum of money afd. when he Should be thereto Afterwards required unto ye. said Henry well & faithfully would pay & Content, Neverthe Less ye. said John his promise and Assumption afd. in form afd. made not regarding but minding to deceive and Defraud the sum of money afd. unto ye. said Henry hath not paid or him for ye. Same in Any Sort Contented altho ye. Same to do ye. Same John Afterwards to wit, ye. Same day and year afd. and often Since at ye. County afd. by ye. said Henry was required) but the Same to him to pay hitherto hath refussed and still doth refuse whereupon ye said Henry Says he is worse and hath Damage to ye. value of Fifteen pounds Current Money of Maryland and thereof he brings Suit &c. Pledges &c. J. Doe & R. Roe Att Which day here Came ye. afd. Henry Ward as ye. afd. John Covington by their Attys afd. and hereupon ye said John as before Defends ye. force and Injury When &c. And Saith that he Cannot deny ye. Action afd. of ye. afd. Henry Ward nor but that he did Assume upon himself in manner and form as ye. afd. Henry above against him hath Complained and as to ye. Damage by of ye. Same Henry ^ him by Occasion of ye. Premisses in that Part Sustained ye. same John Saith & Acknowledgeth that the afd. Henry hath Sustained Damages by Occasion of ye. Premisses beyond his Costs and Charges by him about his Suit in that part apposed to nine pounds nine shillings and Seven pence Current money and not more & because ye afd. Henry denys not this but ye. Same allegation grants to be true prays Judgment for those Damages above acknowledged together with his Costs & Charges afd. to be adjudged therefore by Consent of ye. Parties afd. it is Considered that ye. afd. Henry recover against ye. afd. John Covington his Damages afd. to ye afd. Sum of nine pounds nins shilling & Seven pence Current money by ye. Same John in form afd. acknow ledged |
