June Court 1763 245 to & for ye use of a certain John Scarborough unless the said George Buchanan and William Hamil -ton by themselves or their Attorneys shall appear & answer unto ye said John Scarborough in a plea of trespass upon ye case &c according to Law & that by good & lawfull men of your bailywick you make known unto ye person or persons in whose hands you make ye same Attachment that he she or they be and appear before our Justices of our County Court of Somerset To be held as afsd to shew cause if any he she or they have why ye same Goods Chattles & credits so attached in his her or their hands ought not To be condemned & Execution thereof had & Maid according to act of assembly in such case made & provided if to him her or them it shall seem meet & how you shall Execute this writt that you make known unto our said Justices at ye day & place afsd & have you then & there this writt Wittness Ro- -bert King Esqr Chief Justice of our said Court ye 18th day of August In ye 2d: year of our dominion &c Anno Dom. 1752 Att which day here came the afsd: John Scarborough by William Hayward his Attorney and the sheriffe To wit Nehemiah King now here returned the Foregoing writt of Attachment Endor -sed in manner Following Somerset County fst I do hereby certify that by Virtue of the within writt to me directed on the nineteenth day of August in the year of our Lord God one thousand seven hundred and fifty Two within my Bailywick I Attached of the goods Chattles and credits of George Buchanan and William Hamilton to the Value of thirteen pounds Sterling and Eight hun- -dred pounds of Tobacco in the within writt mentioned in the hands of Coll. George Gale and Alexander Addams severally and I do further Certify that by John Doe and Richard Row good and lawfull men within my Balawick I made known unto the said Col. George Gale and Alexander Addams Severally that they be and appear before the Justices within mentioned at the Time and place within Specifyed to shew cause and So Forth as by that writt I am Commanded So answers N King Shriff And the afsd Alexander Addams Garnishee of the afsd George Buchanan & William Hamilton by Robert Jenckins Henry his Attorney comes and prays leave thereof to Imparle here untill next Court to be held at princess Ann Town the third tuesday of March then next following and he hath it and the same day is given to the afsd: John Scarborough here also and So Forth Att which day here came as well the afsd: John Scarborough as the afsd Alexander Addams Garni- -shee as afsd: by their Attorney's afsd: ad hereupon the afsd: Alexander prays further leave thereof to Imparle here untill next Court To be held at princess Ann Town the third tuesday of June then next following and he hath it and the same day is given to the afsd: John Scarborough here also & So Forth Att which day here came as well the afsd: John Scarborough as the afsd Allexander Addams Gar- -nishee as afsd by their Attorneys afsd and hereupon the afsd: Alexander prays further leave thereof to Imparle here untill next Court to be held at princess Ann Town the third tuesday of August then next following & he hath it & the same day is given to the afsd John Scarborough here also & So forth Att which day here came as well the afsd John Scarborough as the afsd: Alexander Addams Garnishee as afsd: by their Attorneys afsd and hereupon the afsd Alexander prays further Leave thereof to Imparle here untill next Court to be held at princess Ann Town the third tuesday of November then next following and he hath it and the same day is given to the afsd: John Scarborough here also & So Forth And hereupon the sd George Buchanan & William Hamilton by Littleton Dennis their Attorney come and say that they the afsd: George & William are ready to answer unto the afsd: John Scarborough in a plea of trespass upon the case according to Law and to give him the said John Scarborough special bail to the afsd plea and to stand and abide the Judgement of the Court thereupon and So Forth Thereupon a certain Henry Lowes of Somerset County present here in Court in his proper person under an -took for the said George Buchan^ & William Hamilton (& each of them) and assumed upon himself that if it should happen that Judgement in the plea afsd: should be rendred for the said John Scarbo -rough against the afsd: George Buchanan & William Hamilton or that the said George & William should be therein Convict that then they the said George & William should pay and satisfy unto the afsd: John & each of their Scarborough the Judgement of the Court thereupon or render their ^ bodies in Execution of such Judge- -ment to the prison of the sheriff of the county afsd: in satisfaction thereof or that he the said Henry Lowes will do the same for them &c Whereupon the afsd: John Scarborough complain- -ed against the afsd George Buchanan & William Hamilton in the plea afsd: in form following Somerset |
