JP    Joseph Forman    Command was given to the sheriffe of Somerset County that he Should take

vs    James Hardy Late of Somerset County planter if he should be found in his bailywick
SW    James Hardy    and him should safe keep so that he might have his body before the Justices of his
Lordships county court of Somerset To be held at princess Ann Town the third tuesday of November Anno
Domini one thousand seven hundred and sixty Two to answer unto Joseph Forman of a plea of tres
-pass upon the case and so Forth and the same day is given to the afsd: Joseph Forman here and so forth
Att which day here came the afsd: Joseph Forman by Josiah Polk his Attorney and the sheriffe to wit Eph
-raim Wilson now here returned that he had taken the afsd James Hardy whose body here at this day
he had ready to answer the afsd Joseph Forman of the afsd: plea as to him it was commanded &c
And hereupon at the prayer of the parties afsd: Joseph Forman the afsd: James Hardy is adjudged to give
special Bail to the action afsd              Whereupon a certain Joseph Scrogin of Somerset
County present here in court in his proper person undertook for the said James Hardy and assumed
upon himself that if it should happen that Judgement in the plea afsd should be rendred for the said
Joseph Forman against the afsd James Hardy or that that the said James Hardy should be therein convict
that then he the said James should pay and satisfy unto the afsd. Joseph Forman the Judgement of the
court thereupon or render his body in Execution of such Judgement to the prison of the sheriffe of the
county afsd in Satisfaction thereof or that he the said Joseph Scrogin will do the same for him &c
And hereupon the afsd James Hardy puts in his place Samuel Wilson Gent: Attorney at Law against the
afsd: Joseph Forman of the afsd: plea                 And hereupon at the prayer of the parties afsd
day is to them now here given untill next Court To be held at princess Ann Town the third tuesday of
March then next following in the state that now saveing to the parties afsd
Att which day here came the parties afsd by their Attorneys afsd: and hereupon the afsd: Joseph Forman
complained against the afd. James Hardy in the plea afsd in form following
Somerset fst James Hardy Late of Somerset County planter was attached to answer unto Joseph Forman
of a plea of trespass upon the case &c         And Whereupon the said Joseph Forman by Josiah
Polk his Attorney complains that whereas the said James on the nineteenth day of January Anno
Dom. MDCCLXI at the county afsd: was Indebted unto the said Joseph in the sum of Five pounds six
shillings and four pence Current money of Maryland for the articles in the account hereto annexed
mentioned and so thereof Indebted being the said James in consideration thereof afterwards to wit the
day and year afsd: at the county afsd upon himself did Assume and to the said Joseph then and there
faithfully promise that he the said James when he should be thereto afterwards required the
sum of money afsd to the said Joseph he would faithfully pay and content Whereas also the said
James on the Twenty First day of November Anno Dom. MDCCLXI at the county afsd: was
Indebted unto the said Joseph in the further Sum of three pounds two shillings and four pence
halfpenny Current money of Maryland for the Articles in the account hereto anned mentioned
and so thereof Indebted being the said James in consideration thereof afterwards to wit the day and
year Last afsd. at the county afsd: upon himself did assume and to the said Joseph then and there faithfully
promised that he the said James when he should be thereto afterwards required the sum of Money last afsd to
the afsd: Joseph he would faithfully pay and content Whereas also the said James on the tenth day
of February Anno Dom. MDCCLXII at the county afsd was Indebted unto the said Joseph in the further
sum of one pound eight shillings and ten pence Current money of Maryland for the articles in one
other account thereto annexed mentioned and so thereof Indebted being the said James in consideration
thereof afterwards to wit the day and year last afsd at the county afsd. upon himself did assume and
to the said Joseph then and there faithfully promised that he the said James when he should be
thereto afterwards required the sum of money Last afsd To the afsd Joseph he would faithfully
pay and content Nevertheless the said James his severall promises and assumptions afsd in form
afsd: made not regarding the several Sums of Money afsd: to the afd Joseph he hath not paid nor
him for the same in any sort Contented but that to do altogether hath refused and still doth refuse altho
the same to do afterwards to wit the day and year last afsd: at the county afsd: and often since that
