Att which day here came the parties afsd. by their Attorneys afsd. & hereupon the afsd Charles Redding
complained against the afsd: Stephen Garland in the plea afsd: in form following
Somerset fst Stephen Garland late of Somerset County Planter was attached to answer unto Charles
Redding of a plea of trespass upon the case & So Forth         And Whereupon the said Charles
by George Hayward his Atty: complains that whereas the said Stephen the XIX day of October Anno
Dom. MDCCLXI at the county afsd: was Indebted unto the said Charles in the sum of three pounds Three
shillings Current money of Maryland for the article and thing in the account hereto annexed mentio
-ned and so thereof Indebted being the said Stephen in consideration thereof afterwards to wit the same
day and year afsd: at the county afsd: upon himself assumed and to the said Charles then and
there faithfully promised that he the said Stephen the sum of money afsd: when he should
be thereto afterwards required unto the said Charles well and faithfully would pay & content
Nevertheless the said Stephen his Promise & assumption afsd: in form afsd made Little regarding
but minding & fraudulently Intending the said Charles in this particular Craftily & subtilly To
deceive & defraud the sum of money afsd unto the said Charles hath not paid or him for the same in
any sort contented (altho the same to do the same Stephen afterwards to wit the same day &
year afsd and often Since at the county afsd by the said Charles was required) but the same to him
to pay hitherto altogether hath refused & still doth refuse & unjustly deny Whereupon the said Charles
says he is worse & hath damage to the Value of Ten pounds Current money of maryland & thereof
he brings suit & so forth, pledges &c J Doe & R Roe       Stephen Garling    Dr    Errors Excepted

   1761 October 19th To 31 1/2 days work @ 2/ pr Day 3..3..0 pr me Charles Redden
And the afsd: Stephen Garland by his Attorney afsd: comes & defends the force and injury when &c and
prays leave thereof to Imparle here untill next Court to be held at princess Ann Town the third
tuesday of November then next following & he hath it & the same day is given to the afsd Charles
Redding here also &c                 Att which day here came as well the afd Charles
Redding as the afsd: Stephen Garland by their Attorneys afsd: and hereupon the afsd: Stephen
prays further Leave thereof to Imparle here untill next Court to be held at princess Ann Town
the third tuesday of March then next following & he hath it & the same day is given to the afsd Charles
here also &c                 Att which day here came as well the afsd Charles Redding
as the afsd: Stephen Garland by their Attorneys afsd: and hereupon the afsd Stephen prays fur
-ther leave thereof to Imparle here untill next Court to be held at princess Ann Town the third
tuesday of June then next following & he hath it & the same day is given to the afsd Charles here also &c
Att which day here came as well the afsd: Charles Redding as the afsd: Stephen Garland by
their Attorneys afsd: and hereupon the afsd: Stephen as before defends the force and injury when
&c and says that he cannot deny the action afsd: of the afsd: Charles Redding nor but that he
did assume upon himself in manner and form as the afsd Charles above against him hath com
plained and as to the damage of the same Charles by him by occasion of the premises in that
part sustained the same Stephen Garland saith and acknowledgeth that the afsd: Charles hath
sustained damages by occasion of the premises beyond his costs and charges by him about
his suit in that part opposed to three pounds three shillings Curt: Money and not more and
because the afsd: Charles Redding denies not this but the same Allegation grants to be true
prays Judgement for these damages above acknowledged together with his costs and charges
afsd: to him to be adjudged &c       Therefore by consent of the parties afsd: it is considered that
the afsd: Charles Redding recover against the afsd. Stephen Garland his damages afsd to the
afsd three pounds three shillings Currt: Money by the afsd: Stephen in form afsd. acknowledged
496    as also                                pounds of Tobacco for his costs & charges afsd: to the same Charles
