June Court 1763 237 Redding at his request by the court now here of the assent of the parties afsd Adjudged which certain damages in the whole amount to three pounds three shillings Curt: Money and pounds of tobacco and the afsd: Stephen in mercy
might have his body before the Justices of his Lordships county court of Somerset to be held at princess Ann Town the third tuesday of June Anno Dom. 1763 To answer unto Abraham Gibbs of a plea of trespass upon the case &c & the same day is given to the afsd Abraham here &c Att which day here came the afd. Abraham Gibbs by Littleton Dennis his Attorney & the sheriffe to wit Ephraim Wilson now here returned that he had taken the afsd Micha -el Taylor whose body here at this day he had ready to answer the afsd. Abraham Gibbs of the plea afsd as to him it was commanded &c And hereupon the afsd. Abraham Gibbs complained against the afsd. Michael Taylor in the plea afsd in form following Somerset fst Michael Taylor Late of Somerset County shipwright was attached to answer unto Abraham Gibbs of a plea of trespass upon the case &c And Whereupon the said Abraham by Litt: Dennis his Attorney complains that whereas the said Michael & the said Abraham on the first day of December Anno Dom. MDCC -LXII had accounted together and on that accounting the said Michael was found in arrear unto the said Abraham in the sum of five pounds seventeen shillings Current money and so in arrear found being the said Michael afterwards to wit the day and year afsd. at the county afd/ upon himself did assume and to the said Abraham then and there promise that he the said Michael the afd: Sum of money when he should be thereto afterwards requi -red unto the said Abraham he would pay Nevertheless the said Michael his promise and assumption afsd. in form afsd. made not regarding the said Sum of money unto the said Abraham he hath not paid but the same to him to pay hath refused and still doth refuse altho the same to do afterwards to with the day and year afd: at the county afd: and often since that Time by the said Abraham required to the damage of the said Abraham ten pounds Current money and thereof he brings Suit &c pledges &c J Doe R Roe
above against him hath complained & as to the damage of the same Abraham Gibbs by him by occasion of the premises in that part sustained the same Michael Taylor saith and acknwoledgeth that the afsd Abraham hath sustained damages by occasion of the pre -mises beyond his costs and charges by him about his suit in that part Opposed to five pounds |
