June Court 1763 236 Attorneys afsd and hereupon the afsd Thomas prays further Leave thereof to Imparle here until next Court to be held at princess Ann Town the third tuesday of March then next following & he hath it and the same day is given to the afsd George here also &c Att which day here came as well the afsd: George Scott as the afsd Thomas Sloss by their Attorneys afsd & hereupon the afsd. Thomas pray further Leave thereof to Imparle here untill next court to be held at princess Ann Town the third tuesday of June then next follow -ing and he hath it and the same day is given to the afsd George here also &c Att which day here came as well the afsd George Scott as the afsd Thomas Sloss by their Attorneys afsd: and hereupon the afsd: Thomas Sloss as before defends the Force and Injury when &c and prays an hearing of the writing obligatory aforesaid which he hath in the following words and figures to wit : : which being read & heard he prays also a hearing of the condition of the same writing obligatory and he hath it in the following Words to wit : : which being read & heard he says that he to be burthened by the writing obligatory aforesd: ought not because he says that the next provincial Court mentioned in the condition of the said writing obligatory was held at the city of Annapolis to wit at Somerset county on the second tuesday of April In the year of our Lord God seventeen hundred and fifty seven and not before and that after the said Twenty second day of November in the year of our Lord God seventeen hundred and fifty six and before the said second tuesday of April in the year of our Lord God seventeen hundred and fifty seven to wit the thirtieth day of December In the year of our Lord God seventeen hundred and fifty Six the aforesaid Day Scott died to wit at Somerset County aforesaid and this he is ready to Verify where fore he prays Judgment if he to be burthened by the writing obligatory aforesaid ought and So Forth And hereupon the afsd. George Scott Admr: as afsd then and there his writt and declaration afsd: against the afsd: Thomas Sloss did not prosecute with effect but voluntarily suffered his Suit to be discontinued &c
before the Justices of his Lordships county court of Somerset to be held at princess Ann Town the third tuesday of June Anno Domini one thousand seven hundred and sixty two to answer unto Charles Redding of a plea of trespass upon the case &c & the same day is given to the afsd Charles here &c Att which day here came the afsd: Charles Redding by George Hayward his Attorney and the sheriff to witt Ephraim Wilson now here returned that he had taken the afsd: Stephen Garland whose body here at this day he had ready to answer the afsd Charles Redding of the afsd plea as to him it was commanded &c Whereupon the said Stephen Garland puts in his place William Hayward Gent: Attorney at Law against the afd Charles Redding of the afd plea at And hereupon ^ the prayer of the parties afsd day is to them now here given untill next Court to be held at princess Ann Town the third tuesday of August then next following in the state that now saveing to the parties afsd: Att |
