June Court 1763 235 leave thereof to Imparle here untill the Next Court to be held at princess Ann Town the third tuesday of March then Next following & he hath it & the same day is given to the afsd John here also &c Att which day here came as well the afsd John Whittingham as the afsd Denwood Turpin by their Attorneys afsd. and hereupon the afsd. Denwood Turpin prays further Leave thereof to Imparle here untill next Court to be held at princess Ann Town the third tuesday of June then next following & he hath it and the same day is given to the afd. John here also &c Att which day here came as well the afd John Whittingham as the afd Denwood Turpin by their Attorneys afsd And hereupon the afd John Whittingham then & there his writt & declara -tion afsd against the afsd Denwood Turpin did not prosecute with effect but Voluntarily suffered his suit to be discontinued Therefore it is considered by the court here that the afsd. John Whittingham take Nothing by his writt & declaration afsd. but that he & his pledges of prosecuting to wit John Doe and Richard Roe are in mercy and that he the afd Denwood Turpin goe thereof without day & further it is considered that the afsd. Denwood Tur -pin Recover against the afd. John Whittingham 251 pounds of Tobacco for his costs & charges by him about his defence in this part sustained to the same Denwood Turpin by the court now here according to the Form of the statute in such case lately made & provided adjudged & that the same Denwood have thereof Execution &c
-ships county court of Somerset to be held at princess Ann Town the third tuesday of June Anno Dom. One thousand seven hundred and sixty one to answer unto George Scott admi -nistrator of all and singular the Goods and Chattles Rights and credits of Day Scott deceased who dyed intestate of a plea that he render him fifty five pounds ten shillings and two pence Current money of maryland and the Quantity of two thousand two hundred and ninety four pounds of Tobacco which from him he unjustly detains &c & the same day is given to the afsd George Scott here &c Att which day here came the afd George Scott by Littleton Dennis his Attorney & the heriff to wit John Dennis now here returned that he had taken the afsd. Thomas Sloss whose body here at this day he had ready to answer the afsd. George Scott of the plea afsd. as to him it was commanded &c Whereupon the said Thomas Sloss puts in his place Samuel Wilson Gent: Attorney at Law against the afsd. George Scott of the afsd plea And hereupon at the prayer of the parties afsd. day is to them now here given untill next court to be held at princess Ann Town the third tuesday of August then next following in the state that now saveing to the parties afd. Att which day here came the parties afsd. by their Attorneys afd. & hereupon the afsd George Scott declared against the afd. Thomas Sloss in the plea afsd. in form following Somerset fst Thomas Sloss Late of Somerset County Merchant otherwise called Thomas Sloss was sumoned to answer unto George Scott administrator of all and singular the goods and Chattles Rights and credits of Day Scott deceased who dyed Intestate of a plea that he render him fifty five pounds ten shillings and two pence Current money of maryland and the Quantity of two thousand two hundred & ninety four pounds of Tobacco which from him he unjustly detains and so forth And |
