June Court 1763 234 was commanded &c and further the same sheriff returned that he had served the afd William Outterbridge with a copy of the foregoing declaration according to act of assembly in such case provided &c hereupon And ^ the afsd William Outterbridge at the prayer of the afd Levin Ballard is adjudged to give special bail to the action afsd. Thereupon a certain Ephraim King of Somerset County Gent. Present here in court in his proper person undertook for the said William Outterbridge & assumed upon himself that if it should happen that Judgement in the plea afsd. should be rendered for the said Levin Ballard against the afsd. William Outerbridge or that he the said William should be therein convict that then he the said William should pay & satisfy unto the afd Levin Ballard the Judgement of the Court thereupon or render his body in Execution of such Judgement to the prison of the sheriff of the county afsd. in satisfaction thereof or that he the said Ephraim King will do the same for him &c Whereupon the said William Outerbridge by Littleton Dennis his Attorney comes and defends the force & injury when &c & says that he cannot deny the action afsd. of the afsd Levin Ballard nor but that he did assume upon himself in manner & form as the afsd. Levin Ballard above against him hath complained and as to the damages of the same Levin by him by occasion of the premises in that part sustained the same William Outter -bridge saith & acknowledgeth that the afsd. Levin hath sustained damages by occasion of the premises beyond his costs and charges by him about his suit in that part oppo -sed to Seven pounds nine shillings & eight pence half penny Curt: Money and not more and because the afd Levin Ballard denies not this but the same allegation grants to be true prays Judgement for these damages above acknowledged together with his costs & charges afsd. to him to be adjudged &c. Therefore by consent of the parties afsd. it is considered that the afsd. Levin Ballard recover against the afd William his damages afsd to the afsd. seven pounds nine shillings & eight pence halfpenny Curt Money by the afsd. William in form afsd. acknowledged as also pounds of Tobacco for his costs and charges afd to the same Levin at his request by the court now here of the assent of the parties afsd. adjudged which certain damages in the whole amount to seven pounds nine shillings & eight pence halfpenny Curt: Money and 228 pounds of Tobacco And the afsd William in Mercy &c Stay till Aug Crt
before the Justices of his Lordships county court of Somerset to be held at princess Ann Town the third tuesday of March Anno Domini one thousand seven hundred & sixty one to answer unto John Whittingham of a plea wherefore with force and arms a certain Hound Dog of John him the said ^ Whittingham of the price of three pounds Current money of maryland at Somerset County afsd. he did kill and other harms to him then & there did to the grevious damage of the said John and against our peace that now is &c & the same day is given to the afd John here &c Att which day here came the afd John Whittingham by George Hayward his Attorney & the sheriff to wit John Dennis now here returned that he had taken the afd Denwood Turpin whose body here at this day he had ready to an -swer |
